Legal Framework • Article 16 / Regulation 1080/2006 • Each Member State shall set up a control system making it possible to verify the delivery of the products and services co-financed, the soundness of the expenditure declared for projects implemented on its territory, and the compliance with Community rules and its national rules and each Member State shall ensure that the expenditure can be validated by the controllers within a period of three months. • Article 13 / Regulation 1828/2006 • The verifications to be carried out shall cover administrative, financial, technical and physical aspects of projects, as appropriate. www.cbcromaniabulgaria.eu

  3. Who are the controllers? A first level control system has been established both in Romania and Bulgaria in order to check the expenditure made by the project partners from each country. Therefore, each partner has the obligation to ensure that its expenditures are checked and validated by a controller from the state on whose territory it is located, before the reimbursement request is submitted. - In Romania, the controllers are hired staff of the Regional Office for Cross Border Cooperation Calarasi (also hosting the JTS). - In Bulgaria, the controllers are contractual staff, contracted by the National Authority. www.cbcromaniabulgaria.eu

Responsibilities of the Lead Partner • The Lead Partner and all partners must present their documents to the first level controllers, in order for these documents to be verified before the drafting, elaboration and forwarding of the reimbursement claims. The request for control is addressed to the JTS (for Romanian partners) or to the NA (for Bulgarian partners) with at least 45 working days before the deadline for submitting a reimbursement claim to the JTS. • 2) The Lead Partner ensures, through verifications/controls – periodical or ad-hoc, that the partners present their expenditures to the controllers for verifications. www.cbcromaniabulgaria.eu

Responsibilities of the Partner All partners must present their documents to the first level controllers, designated by MA and NA respectively, in order for these documents to be verified before the drafting, elaboration and forwarding the reimbursement claims. The request for control is addressed to the JTS (for Romanian partners) or to the NA (for Bulgarian partners) with at least 45 working days before the deadline for submitting a reimbursement claim to the JTS. 2) After the control is performed, all partners must submit their contribution for the reimbursement claim to the Lead Partner, with at least 15 days before the deadline for submitting the reimbursement claim to the JTS. www.cbcromaniabulgaria.eu

  6. How does the control work (1)? Request of control The partners will complete and submit to the BRCT/NA, in hard copy, the following documents: 1. Notification/Request of first level control. 2. List of eligible expenditures incurred during the reporting period. 3. Expenditures situation. Progress report (contribution related to each partner). Expenditure justification documents Templates for each of the above mentioned documents are included in the project implementation manual (Fiche 10). www.cbcromaniabulgaria.eu

  7. How does the control work (2)? Performing the control On the desk – all the documents submitted by the partner are checked against the EU and national laws, applicant guide, financing contracts etc. 2) On site visit – the delivery of services, goods and works as well as the original documents of the partners are checked on site (at the partner premises and/or at the project implementation site). The conclusions and results of the verifications on site will be recorded in a report that will be signed both by the controller and by the representative of the project partner. After the controller finalizes its report, it will be sent to the respective partner. The partner shall have the responsibility to annex this report to its contribution to the reimbursement claim and submit it to the Lead Partner, at least 15 days before the deadline for submitting the reimbursement claim to the JTS. www.cbcromaniabulgaria.eu
