  1. PARTNERSHIP Lead partner - The applicant designated by the partners involved in a project responsible for coordinating the process of development, submission and implementation of that specific project. Partner – Any applicant involved in the project. Partnership Agreement - is concluded between the partners (usually after project acceptance for financing) and stipulates the partners’ rights and duties. The partners shall set up a Project Joint Steering Committee, made up of representatives of all partners. www.cbcromaniabulgaria.eu

Partnership • At least one partner form Romania and one partner from Bulgaria, which must fulfil also all eligibility criteria stated in the applicant guide for the call for proposals. • The maximum number of partners is indicated in the Applicant Guide for the respective call for proposals. • At least two of the following four cooperation criteria must be observed: • Joint development • Joint implementation • Joint staffing • Joint financing www.cbcromaniabulgaria.eu

  3. Responsibilities of the Lead Partner Signs and submits the application form. Ensures the coordination, management and general implementation of the entire operation. Remains in contact with the bodies involved in the implementation of the Programme. Receives the ERDF amounts accepted for financing for the entire project. Ensures that the operation starts and is implemented in due time. Is responsible for claiming payments from the MA and for the management of ERDF amounts, especially for the transfer in due time of these amounts to the partners, according to the contribution of each partner to the operation and in line with the validated expenditures. www.cbcromaniabulgaria.eu

Responsibilities of the Lead Partner • Collects all documents from the partners in order to complete the reimbursement claims and progress reports. • Ensures, through verifications/controls – periodical or ad-hoc , that the partners present their expenditures to the controllers for verifications. • Keeps track of the project activities, of the amounts received from the MA and of the transfers to the partners. • Informs the partners regarding the relevant communications with the implementing bodies of the programme. • Ensures the correctness of the accounting and financial reports and documents drawn up by the Project Partners. www.cbcromaniabulgaria.eu

  5. Responsibilities of the Partner Implements the part of the operation for which it is responsible, in due time. Observes the national and European legislation in general and especially on public procurement, state aid, equal opportunities, sustainable development, environmental protection. Is responsible for its budget up to the amount it participates in the operation. Maintains a proper analytical accounting system and separate bank accounts for the operation. Supports the lead partner in drawing up progress reports and the final report by providing the required data on time www.cbcromaniabulgaria.eu

  6. Responsibilities of the Partner Has the obligation to respond to any request of the Lead Partner in the deadline stipulated in the respective requests. Must present the documents related to the expenditures to the first level control and then submit these documents to the Lead Partner, for centralization, but not later than 15 days before the deadline for submitting the reimbursement claims to the Joint Technical Secretariat. Presents all documents required for the audit, control or evaluation, provides necessary information and gives access to its business premises.   7. Project Joint Steering Committee The partners shall set up a Project Joint Steering Committee, made up of representatives of all partners. The partners must establish the PJSC after the signing of the subsidy contract, but they may choose to establish the PJSC in the project development phase, in order to have a better continuity with the implementation phase. The Lead Partner is responsible for setting up the Project Joint Steering Committee before the first reimbursement claim is submitted. ·  The tasks of the Project Joint Steering Committee shall be established through the Rules of Procedure of this Committee and shall automatically include the tasks stipulated in the partnership agreement: -approving the reimbursement claims and progress reports; -approving requests for changes in the contracts; -settle any dispute between partners; -preparing the list with members of the arbitrary court; -terminating the partnership agreement. www.cbcromaniabulgaria.eu
