  2. NATURAL HAZARDS: Occur anywhere and anytime. However, proper education and organisational development Can Prevent most natural hazards from turning into disaster. Let us get acquainted with the Act & Rules pertaining to Environmental protection as regards to hazardous materials as well as waste management which may lead to disaster if properly not understood.

  3. The Manufacturer, Use, Import, Export and Storage of Hazardous Micro-Organism Genetically Engineered Organism or Cells Rules, 1989. 2. The hazardous wastes (Management & Handling) Rules, 1989, as amended to date. 3. The chemical Accidents ( Emergency Planning Preparedness and Response) Rules, 1996 4. The Public Liability Insurance Rules, 1991, as amended to date.

  4. Industrial Units or activities or any unit under the • Acts & Rules of Pollution Control Board pertaining to Manipur & covered for Authorisation, Consent. • LPG Bottling Plant at AwangSekmai. • NHPC Leimatak. • Cement Plant at Senapati (yet to start). • Iron manufacturing unit (Satyam Industries at Taphou, Senapati). • IOC depot at Chingmeirong. • Municipal Solid Waste (MSW) at LamdengKhunou (Yet to function). • Stone Crushers 100 TPH along NH 53 for railway work. • Tipaimukh Hydro Electric Multipurpose Project (EIA Cleared).

  5. Before we go into details of Pollution Control Measures • Let us refresh our minds what are: • Hazardous Waste means – • Waste substances which are generated in the process indicated in column – 2 of schedule-I and consists of wholly or partly of the waste substances referred to In column 3 of the same schedule; • (b) Wastes substances which consists wholly or partly of substances indicated in Schedule-2, unless the concentrations of the substances is less than the limit Indicated in the same schedule; and • (c ) Wastes substances indicated in Part-A, List ‘A’ and ‘B’ of schedule-3 applicable only to rules 12, 13 and 14 unless they do not possess any of the hazardous characteristics in Part-B of the same schedule.

(j) “hazardous waste site” means a place for collection, reception, treatment, storage and disposal of hazardous which has been duly approved by the competent authority. • “Import” with its grammatical variations and cognate expressions, • Means bringing into India from a place outside India. • (l) “Importer”, means an occupier or any persons who imports hazardous wastes; • (m) “operator of facility” means a persons who owns or operate a facility for collection, reception, treatment, storage and disposal of hazardous wastes; • (o) “State Pollution Control Board” means a Board appointed under sub section (I) of the section 4 of the Water (Prevention & Control of Pollution) ACT, 1974(6 of 1974); and under section 4 of Air (Prevention & Control of Pollution) Act, 1981 (14 of 1981); • (p) “transboundary movement” means an movement any hazardous wastes or other wastes from an area under the national jurisdiction of another country or to or through an area not under the national jurisdiction of and country, provided at lest two countries are involved in the movement.

(q) “disposal” means disposal, treatment, storage and recovery of any hazardous wastes; (s) ‘State Government’ means the State Government and in relation to Union Territory, the administrator thereby appointed under Article 239 of the Constitution; (u) ‘transport’ means movement of hazardous wastes by air, rail, road or water; (v) ‘transporter’ means a person engaged in the off-site transportation of hazardous waste by air, rail, road or water; (w) ‘treatment’ means a method, technique or process, designed to change the physical, chemical or biological characteristics or composition of any hazardous waste so as to render wastes harmless; (x) ‘environmentally sound management of hazardous wastes’ means taking all steps to ensure that the hazardous wastes are managed in a manner which will protect human health and the environment against the adverse effects which may result from such wastes; (y) ‘illegal traffic’ means any transboudary movement of the hazardous wastes as specified in rule 15;

  8. Responsibility of the occupier and operator of the facility for handling of wastes – • 4.A. Duties of the occupier and operator of a facility – It shall be the duty of the occupier and the operator of the facility to take adequate steps while handling hazardous waste to, - • (i) contain contaminants and prevent accidents and limit their consequences on human and the environment; and • (ii) provide persons working on the site with informations, training and equipment necessary to ensure their safety. • 4.B. Duties of the authority – Subject to the provisions of these rules, the authority shall also perform duties as specified in Column 3 of Schedule 4.

The Member Secretary, State Pollution Control Board or any officer designated by the Board or committee shall not issue an authorisation unless he is satisfied that the operator of a facility or an occupier , as the case may, processes appropriate facilities , technical capabilities and equipment to handle hazardous wastes safely. 4A. The authorisation application complete in all respects shall be processed by the State Pollution Control Boards within ninety days of the receipt of such application.

  10. THE CHEMICAL ACCIDENTS (EMERGENCY PLANNING, PREPAREDNESS, AND RESPONSE) RULES, 1996 “Chemical Accident” means an accident involving a fortuitous, or sudden or unintended occurrence while handling any hazardous chemicals resulting in continuous, intermittent or repeated exposure to death, or injury to, any person or damage to any property but does not include an accident by reason only of war or radio-activity

THE PUBLIC LIABILITY INSURANCE ACT, 1991 “accident” means an accident involving a fortuitous, or sudden or unintended occurrence while handling any hazardous chemicals resulting in continuous, intermittent or repeated exposure to death, or injury to, any person or damage to any property but does not include an accident by reason only of war or radio-activity

  12. Now let us refer to MoEF notification for EIA 14th September, 2006 SCHEDULE (See paragraph 2 and 7) LIST OF PROJECTS OR ACTIVITIES REQUIRING PRIOR ENVIRONMENTAL CLEARANCE

  13. Note:- • General Condition (GC): • Any project or activity specified in Category ‘B’ will be treated as Category A, if located in whole or in part within 10 km from the boundary of: (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas as notified by the Central Pollution Control Board from time to time, (iii) Notified Eco-sensitive areas, (iv) inter-State boundaries and international boundaries. • Specific Condition (SC): • If any Industrial Estate/Complex / Export processing Zones /Special Economic Zones/Biotech Parks / Leather Complex with homogeneous type of industries such as Items 4(d), 4(f), 5(e), 5(f), or those Industrial estates with pre –defined set of activities (not necessarily homogeneous, obtains prior environmental clearance, individual industries including proposed industrial housing within such estates /complexes will not be required to take prior environmental clearance, so long as the Terms and Conditions for the industrial estate/complex are complied with (Such estates/complexes must have a clearly identified management with the legal responsibility of ensuring adherence to the Terms and Conditions of prior environmental clearance, who may be held responsible for violation of the same throughout the life of the complex/estate).

Construction, operation or decommissioning of the Project involving actions, which will cause physical changes in the locality (topography, land use, changes in water bodies, etc.)
