  2. Discrimination or Harassment is Prohibited at UND • Harassment is a form of discrimination. • Unwanted behavior directed toward an individual or group because of the individual/group’s membership in a protected class • Treating individuals or groups differently because of their protected class • Protected classes include sex, race, national original, color, religion, age, disability, veteran’s status, sexual orientation, gender identity, genetic information, marital status and any other protected class defined by North Dakota or federal law • Harassment can take many forms • Oral, written, graphic, or physical conduct • Writing inappropriate, offensive comments on white boards, bulletin boards, social media accounts, etc • Saying inappropriate, offensive or demeaning comments. • Touching, grabbing, pushing or encroaching on someone’s personal space

Hostile Environment • A hostile environment is created when harassment is sufficiently severe, persistent or pervasive so as to interfere with or limit the ability of the individual/group to participate in or benefit from UND’s employment and educational programs or activities • Based upon membership in a protected class • Can be a series of incidents or pattern of behavior or can be one severe incident • Harassment that creates a hostile environment is unlawful and a violation of UND policies

Title IX • Title IX of the Education Amendments of 1972 prohibits sex discrimination in all university sponsored activities and programs, including: • Admissions • Recruitment and retention • Scholarships and fellowships • Counseling and appraisal materials • Administration of courses • Marital/parental status and pregnancy • Harassment • Employment

Scope of Title IX • Protects faculty, staff and students from sexual harassment, including sexual violence, in an institution’s education programs and activities, including • All administrative, academic, educational, extracurricular, athletic and other programs • Activities that are on-campus, off-campus, in-transit, and sponsored at other locations, etc. • Protects third parties from sexual harassment or violence in an institution’s education programs and activities • High school student participating in college’s recruitment program • Visiting student athlete • Camp participants

Scope of Title IX • Prohibits sex-based discrimination and harassment including • Acts of verbal, nonverbal or physical aggression, intimidation or hostility based on sex, even if those acts do not involve conduct of a sexual nature • Sex-based harassment whether by those of the same sex or not • Discriminatory sex stereotyping and harassment of LGBTQ individuals • Sexual violence

  7. Non-Verbal Sexual Harassment Sexually suggestive staring, leering, sounds or gestures Sexually suggestive or degrading images or graffiti Use of such images to advertise events

Verbal Sexual Harassment Sexual slurs, insults or catcalls Sexual or sexist remarks or jokes about someone’s body, clothing, activities or sexual orientation Unwelcome sexual propositions, demands or pressure for sexual favors Requests for romantic or sexual relations by a person in authority, combined with an implicit or explicit threat or reward

  9. Physical Sexual Harassment Unnecessary and unwanted physical contact (touching, brushing, hugging, pinching) Unwelcome fondling or kissing Sexual violence

  10. Retaliation Retaliating against an individual who reports discrimination, harassment or sexual violence is prohibited Retaliation against an individual who participates in an investigation of discrimination is also prohibited

UND’s Responsibilities • Respond promptly and effectively if UND knows or reasonably should know about discrimination/harassment, sexual violence, or retaliation that creates a hostile environment • Conduct a prompt investigation to determine what occurred and take appropriate steps to resolve the situation • Protect the parties, including interim steps (change of housing, classes, etc.) • A criminal investigation does not relieve UND of its duty to resolve complaints promptly and equitably

Your Responsibilities • If you find out about a discrimination/harassment, sexual violence, or retaliation involving a student, employee or visitor, please share that information with • Your supervisor, • Equal Employment Opportunity/Affirmative Action Director, Donna Smith, 777.4171, or • UND Police Department, 777.3491 or 911 for emergency
