Agenda Item 8:Status of establishment of licensing systems (Article 4B of the Protocol) • Annex I to document ImpCom/45/4 lists 176 out of 181 Parties to the Montreal Amendment to have established licensing systems • The 5 remaining Parties are • Brunei Darussalam • Ethiopia • Lesotho • San Marino • Timor Leste

Agenda Item 8:Status of establishment of licensing systems (Article 4B of the Protocol) • Annex II, section A lists 12 Parties to the Protocol but not yet party to the Montreal Amendment that have established licensing systems • Section B of Annex II have listed the following 3 Parties to the Montreal Protocol that are neither party to the Montreal Amendment and have no licensing systems: • Angola • Botswana • Vanuatu • Status of compliance issue • The 5 Parties that have ratified the Montreal Amendment and are without licensing systems are in non-compliance with their obligation under Article 4B of the Protocol

Agenda Item 8:Status of establishment of licensing systems (Article 4B of the Protocol) Recommendation • The Committee may wish to recommend a decision with following elements: • To urge Brunei Darussalam, Ethiopia, Lesotho, San Marino, Timor Leste which are remaining Parties to the Montreal Amendment to the Protocol and have not yet established licensing systems for ODS to do so and to report to the Secretariat by 31 May 2011 in time for the ImpCom and the MOP in 2011 to review their compliance situation;

Agenda Item 8:Status of establishment of licensing systems (Article 4B of the Protocol) • Recommendation • To encourage Angola, Botswana and Vanuatu which are remaining Parties to the Protocol that have neither ratified the Montreal Amendment nor established import and export licensing systems for ODS to do so; • To urge all Parties that already operate licensing systems for ODS to ensure that they are structured in accordance with Article 4B of the Protocol and are implemented and enforced effectively; • To review periodically the status of the establishment of import and export licensing systems for ODS by all Parties to the Protocol, as called for in Article 4B of the Protocol;
