Anti-Price Monopoly Duty of NDRC • Among the three Anti-monopoly agencies, NDRC is responsible for investigating and treating price monopoly behavior, specifically in three aspects: • Price monopoly agreement reached by the undertakings. • Undertakings with market dominance abuse their market positions to eliminate and restrict competition through price. • Administrative body and agencies empowered by law and provisions to be in charge of public affairs abuse their administrative power to eliminate and restrict competition in the aspect of price.

Strengthen the Enforcement Power of Anti-price Monopoly • A total of 150 manning quota was added to eight provinces and cities, such as Beijing, Liaoning, Shanghai, Jiangsu, Hubei, Guangdong, Chongqing and Shaanxi, which are specially used for the price supervision and inspection and anti-monopoly enforcement. • At present, 9 provinces such as Shanghai, Fujian, Henan, Hubei, Hunan, Guangdong, Yunnan, Ningxia and Qinghai founded the price supervision and inspection and anti-monopoly bureau; 3 provinces such as Liaoning, Jiangsu and Shaanxi set up the anti-price monopoly branch; Jilin increased manning quota; director general of price supervision and inspection bureau Guangdong, Sichuan, Hunan and Hubei are listed as deputy departmental-level cadres; price supervision and inspection agency of Beijing province was approved to update and increase manning quota by the compiling department.

Actively Carry out the Anti-price Monopoly Enforcement • The types of the cases include monopoly agreements among undertakings or industry associations, abuse of market dominance and abuse of administrative power to eliminate or restrict competition, etc. • The cases involves aviation, books, paper, cosmetic, car, insurance, telecommunications, medicine, cement, milk powder, LCD, liquor, gold, sea sand, corn and other industries. • The objects of law enforcement involve state-owned enterprises, private enterprises, foreign-funded enterprises and industry associations.

  11. Actively Carry out the Anti-price Monopoly Enforcement • Two Pharmaceutical Circulation Companies in Shangdong abuse of market dominance • LCD case of Samsung, LG, etc. • Vertical Monopoly case of Maotai and Wulianye • Vertical Monopoly case of powdered milk • companies ……

  12. Constantly Deepen International Communications and Cooperation • Sign the MOU of antitrust cooperation with antitrust enforcement agencies in UK, US, South Korea and EU. • More than 20 seminars were held concerning antitrust-related issues with other countries and regions, and conducted training on more than 1000 provincial antitrust enforcement personnel. • Actively assign officials to attend antitrust-related international conferences. • A total of 3 officials are assigned to intern in the antitrust agencies in EU and its member countries.

  13. Prospect of Anti-price Monopoly in the Next Step • Further promote the role of competition policy in economic development, preventing and curbing the abuse of administrative power to eliminate and restrict competition. • Actively carry out the anti-price monopoly enforcement work, investigate all kinds of monopoly behavior in accordance with law and maintain the market order of fair competition.

Prospect of Anti-price Monopoly in the Next Step • Constantly increase the antitrust-related propaganda, publicize the exposure of typical cases, improve the understanding and awareness of the anti-monopoly law for all parties in society and strive to cultivate competitive culture. • Continue to deepen the antitrust-related international cooperation and communication, absorb the anti-monopoly enforcement experience from other countries and regions, and constantly improve the anti-price monopoly law enforcement ability.
