  5. HW Determination • Listed Hazardous Waste • ANYTHING contacted is a HW • Knowledge of Process • MSDS (beware of “1% content” practice) • Source of Waste • Lab Analysis • Toxic Characteristic Leaching Procedure (TCLP) • Analyze for What is Expected

  6. HW – Solid Waste Defn. • Solid Waste • Discarded Material (no longer of use) • Abandoned Material (implies it’s a waste) • NOT a waste if directly used / reused (value) • Exclusions (i.e. not solid wastes) • Wastewater domestic sewage • Wastewater point-source discharges • Lab discharges to wastewater (<1% of flow) • Scrap Metal • Recycled circuit boards (batteries removed) • Cathode Ray Tubes (CRTs) “Abandoned Drums” Documentation ? Domestic Sewage Wastewater Discharge Lab Discharge Scrap Metal Recycled Circuit Boads TV Monitors

  7. Exempted from HW Regs • Exemptions • Household Waste • Animal Manure • Arsenic Treated Wood • Petroleum Contaminated Soil • CFC Refrigerants • Drained Used Oil Filters • Lab Samples • Empty Containers (meet definition) • Recycled Materials (separate regs) • Lead-Acid Batteries • Precious Metals Recovery • Used Oil • Universal Wastes (batteries, lamps, etc.) Household Waste Manure Treated Wood Refrigerants Lab Samples Empty Containers Used Oil Universal Waste

  8. Special Considerations • Universal Waste • Exempt IF Recycled • Used Oil • Exempt IF Recycled • Used Oil Rebuttable Presumption (contaminated with refrigerants) • Empty Containers • <1” in a Drum • Aerosols Depressurized • “As much removed as feasible”

  9. Volume – Based HW Regulations • Conditionally Exempt Small Quantity Generator • <100 kg (220 lbs) / Month • Small Quantity Generator • < 1,000 kg (2,204 lbs) / Month • Large Quantity Generator • > 1,000 kg (2,204 lbs) / Month • Generator • Status • Document Mo. Volume • Can switch between statuses

  10. Source: Smithfield Foods Environmental Guidelines

  11. CESQG Requirements • 40 CFR 262.11 HW Managed On Site • Hazardous Waste Determination • Accumulate < 1,000 kg HW On Site • Disposal • Ship to an Off-Site Treatment, Storage and Disposal Facility (TSD) • Hazardous Waste Landfill • Municipal Landfill (if approved)

  12. SQG Requirements • Hazardous Waste Determination • All Wastes – Listed or Characteristic ? • Quantity of HW Generated • SQG 100 - 1,000 kg/ Mo • < 6,000 kg On Site • Obtain an EPA ID Number Document / Records Inventory and Track

  13. Storage Requirements • DOT Approved Container (Package) • Apply a Hazardous Label to Container • Accumulation Start Date on Label • Satellite Accumulation Area • 180 days • Up to 55 gallons at one location • Area Security and Posted Signs • Adequate Aisle Space for Emergency Response • Cannot store incompatible materials next to each other • e.g. Acids and Caustics

  14. HW Label Label Immediately Required to Determine Storage Time – 180 days

  15. DOT Hazard Label

  16. Container Management • Ensure Container Integrity • Container Compatible with Waste • Container ALWAYS Closed • Weekly Inspection • Leaking / deteriorating Containers • Aisle Space • Labeling (accumulation start date) • Container Closed • Emergency Postings: Nearest Phone • Quantity in the Container • Containment for Liquids

  17. Emergency Preparedness • Designated Emergency Coordinator On Call • Telephone Nearest Storage Area Posted with: • EC Phone Number • Location of Fire Extinguisher / Spill Response Equipment • Fire Department Phone Number • Employee Emergency Response Training • Emergency Equipment: • Internal Communication or Alarm System • Fire Control Equipment (extinguishers; water) • Spill Response Equipment • Test Emergency Equipment • Arrangements with Local Emergency Responders

  18. Shipping • Manifest Preparation • Normally prepared by TSD • DOT shipping Description • Transporter Information • Destination Facility • Emergency Response Number • HW Numbers and Weight • Signature – DOT trained individual • Offer Transporter DOT Placard(s)

  19. Reporting • Manifest Copy Returned • Within 60 Days • CALL the TSD at 45 days! • Notify EPA if not received • Biennial Report NOT Required • Hazardous Waste Spills / Fires • That threatens human health • Reaches surface waters • Call the National Response Center US EPA Manifest Discrepancy

  20. Record Keeping • Required • 3 year Retention by Law • Smithfield Policy – 30 Years • Copies of Manifests • Waste Determination Documentation • Implied Record Retention • Storage Area Inspections • Training Records • Emergency Response Preparedness

  21. Universal Waste Regulations

  22. Universal Waste – State Additions

  23. Universal Waste – State Additions

  24. Universal Waste – State Additions

  25. Universal Waste • Regulatory Background • Recycled hazardous wastes • 40 CFR 273 • States can add additional wastes • Federal Applicability • Batteries • Pesticides • Mercury-containing equipment • Lamps

  26. Universal Waste - General Small Quantity Universal Waste Handler • Prevent Releases of Waste • Manage Properly • Use Compatible Storage Container • DOT Approved • Store for < 1 year • Containers Remain Closed • Unless adding / removing waste • Label • Type of Universal Waste Stored • Mark with Accumulation Start Date (or an inventory system to demonstrate)

  27. Universal Waste - Labeling • Batteries • “Universal Waste Battery (ies)” or “Used Battery (ies)” • Pesticides • “Universal Waste – Pesticide(s) or “Waste Pesticide(s) • Mercury-Containing Equipment • “Universal Waste – Mercury Containing Equipment” • “Waste Mercury-Containing Equipment” • “Used Mercury-Containing Equipment” • “Universal Waste-Mercury Thermostats” etc. • Lamps • “Universal Waste Lamp(s)” or “Waste Lamp(s)” or “Used Lamp(s)”

  28. Universal Waste Label

  29. Battery Requirements • Segregate Battery Types • May be incompatible • Different DOT Descriptions • Protect Terminals • All Batteries (DOT)

  30. Mercury Requirements • Allowed to remove mercury ampules • E.g. thermostats • Removal over spill containment • Ensure mercury clean-up kit is available • Trained personnel • Place them in a separate sealed container • Packaged to prevent breakage • Can remove the housing from mercury device • Mercury Spill / Cleanup Debris • Must be managed as a hazardous waste

  31. Lamp Requirements • Storage • Structurally Sound Container • Adequate to prevent breakage • Compatible with the lamps • Must remain closed • No signs of damage or leakage • Breakage • Immediately clean up broken lamps • Place in separate, sealed container • State laws may dictate whether this is a HW Mercury ! Lead !

  32. Training & Emergency Response • Train Employees Handling UW • Proper Handling • Emergency Procedures • Respond to Releases • Immediately Contain • If a release is a hazardous waste, manage it as HW Pure Safety Training Individual Employees: - Electricians - Mechanics - Janitors

  33. Recycling Universal Waste • Select Qualified Recycler • Must send to a qualified UW handler • Do Not transport the UW yourself ! • Meet DOT Shipment Requirements • Package, Label, Mark and Placard • Shipping description completed • Signed by a DOT trained person • If shipment contains HW, it will be rejected & EPA notified

  34. Policy Notes • Not required to keep shipment records but, keep all records
