Members viewing the presentation must sign an OSRT sign in sheet. The completed sign in sheet signed by an officer must be submitted to the OSRT planning (Training) Section to receive credit for the training.

  6. OHIO SPECIAL RESPONSE TEAM Vicarious liability refers to liability for the negligent or criminal acts of another person that is assigned to someone by law. Vicarious liability exists when liability is attributed to a person who has control over or responsibility for another who negligently causes an injury or otherwise would be liable. Whenever an agency relationship exists, the principal is responsible for the agent's actions.

  7. OHIO SPECIAL RESPONSE TEAM The employer is charged with legal responsibility for the negligence of the employee because the employee is held to be an agent of the employer. If a negligent act is committed by an employee acting within the general scope of her or his employment, the employer will be held liable for damages.

  8. OHIO SPECIAL RESPONSE TEAM Although it is commonly assumed that employment status is determined by how a person is paid, this is only one of several factors that are considered. Even unpaid volunteer workers may be classified as employees for the purpose of vicarious liability. The usual focus is on payment because most disputes about employment status involve the tax laws rather than the tort laws. The whole work situation is considered when determining whether there is vicarious liability for a person’s actions.

  10. OHIO SPECIAL RESPONSE TEAM Since we are a corporation we must act and/or conduct ourselves in accordance with recognized procedures. Only corporate officers can enter verbal or written contracts for the corporation. Since Vicarious Liability is Involved, Headquarters/Operations must receive: ~ Request for training ~ Notification of real world event.
