  3. Purpose • Public Hearing for Amendments to the 2009 Economic Incentive Plan Ordinance • Worksession – February 15, 2011

  4. 2009 Economic Incentive Plan General Provisions • Extended building permits • Suspended automatic impact fee indexing • Waived increased impact fees for certain use changes • Extended concurrency encumbrances and reservations

  5. 2009 Economic Incentive Plan Ordinance Provisions • Extended Building Permits existing as of January 6, 2009 through December 31, 2010 • Suspended Automatic Impact Fee Indexing • Fire 3.5% • Law 2.5% • Parks 7.4% • Road 3.0%

  6. 2009 Economic Incentive Plan Ordinance Provisions • Waived Increased Impact Fees for Changes in Use • Existing Buildings • Same Building Footprint • Located in Urban Service Area (USA) • Required to be consistent with Comprehensive Plan and Existing Zoning

  7. 2009 Economic Incentive Plan Ordinance Provisions • Capacity Encumbrance Letters • Extended for one year (from 180 days) • Capacity Reservation Certificates • Extended for 5 years (from 3 years) • Allowed for Incremented Payments over extended period of time

  8. 2009 Economic Incentive Plan Sunset Provisions • December 31, 2010 - Extension of building permits - Waiver of change of use impact fee increases - Extension of concurrency encumbrances and reservations • March 10, 2011 - Indexing of law, fire, and parks impact fees • June 30, 2011 - Indexing of road impact fees

  9. Proposed Amendments • Extends provisions until March 31, 2012 - Extension of building permits - Waiver of change of use impact fee increases • Extension of concurrency encumbrances and reservations • Suspension of Impact Fee Indexing • Retroactive to January 1, 2011

  10. Requested Action Make a finding of Consistency with the Comprehensive Plan and approve the Economic Incentive Ordinance. ALL DISTRICTS Note: LPA made a finding of consistency on February 17, 2011
