ERCOT Anti-Trust Admonition ERCOT strictly prohibits Market Participants and their employees who are participating in ERCOT activities from using their participation in ERCOT activities as a forum for engaging in practices or communications that violate the antitrust laws. The ERCOT Board has approved guidelines for members of ERCOT Committees, Subcommittees and Working Groups to be reviewed and followed by each Market Participant attending ERCOT meetings. DAM Summary • Thirteen DAMs executed so far (summary of this week below) • May 28- (no guardrails) • Without constraints • Average LMP = $21 • No AS Insufficiency • Procured hourly average of 15,000 MW/hour of Energy • 83 QSEs participated • May 30- (no guardrails) • Without constraints • Average LMP = $50 • No AS Insufficiency • Procured hourly average of 27,000 MW/hour of Energy • 84 QSEs participated • RUC successfully executed for May 28 and 30 • Ran in unconstrained mode to solve capacity shortage only • During April and May ERCOT executed: • 13 DAMs (constrained and unconstrained, last two without guardrails/scripting) • 6 DRUCs, 2 HRUCs, 2 SASMs http://nodal.ercot.com 4

DAM Summary EIP 1.14 released • In Sandbox as of 5/22 • EDS migration 6/5 • Includes following additional functionality related to EDS 4 Release 9.3: • Individual AwardSets (AwardedAS, AwardedCRR, AwardedPTPObligation, AwardedEnergyBid, AwardedEnergyOnlyOffer, AwardedEnergyOffer (aka Three Part Offers)) • When migrated to EDS, QSE can query individual AwardSets from previous markets http://nodal.ercot.com 5

Update on EDS4 Initial DAM/RUC 4.9.3 Testing • At this point in time ERCOT is not planning to execute subsequent DAM, DRUC, HRUC, SASM in the existing environment • ERCOT will maintain and support the existing EDS environment • Allows for QSE market submissions • Allows for downloading of prior market results/awards • Suspension of DAM/RUC execution will allow: • ERCOT to focus on expediting migration to MMS4 for EDS • ERCOT to address missing integration to achieve a more realistic DAM/RUC • ERCOT to develop analytic tools to better respond to market questions • QSE and ERCOT to focus on EIP testing and delivery • MMS4 submission changes, Notifications of awards, RUC instruction, AS Obligations, etc. • Discontinue 4.9.3 DAM/RUC/CommOps market calls but all other communication channels and systems still available (eds4@ercot.com) • NOTE- No changes to other EDS activities (EDS2, EDS3 SCED/LFC/CRR, EDS4 Outages) • Working with Nodal Program and TPTF to coordinate and deliver upgrade to EDS for Day-Ahead Markets and next level of integration among nodal systems. http://nodal.ercot.com 6

Posting Assumptions and General Information Data Assumptions • All data was originally created for testing purposes and is NOT intended to be production like • Black Start Availability is assumed to be 100% • There were no valid RMR contracts on test operating dates • 1-4-08 is for RTM settlement without DAM execution General Information • Each Operating Date “Settlements Directory” (ex. 1-1-08 RTM Initial Settlements) contains all interval and non-interval input data, output data as well as HTML and XML version of statements • The RTM Invoices directory contains the RTM invoices that invoice Initial Settlements for operating dates 1-1-08 and 1-4-08 • The RTM Late Fee Invoices directory contains all late fee invoices as well as an explanation spreadsheet http://nodal.ercot.com 8
