Purpose of the Presentation • The purpose of the presentation is to provide the NCOP Select Committee on Finance with a progress report on disciplinary matters in the following provincial departments in Limpopo which are under Section 100 (1) (b) intervention • Education, • Health, • Public Works, • Roads and Transport, and • Treasury.

BACKGROUND • In December 2011 5 Limpopo Provincial Departments were put under Section 100(1)(b) of the Constitution. • On 22 December 2011 the Anti Corruption Task Team (ACTT)was requested to make capacity available to ensure the fast tracking of investigations and prosecutions where corruption and criminal conduct were identified in the intervention. The ACTT is constituted by the following institutions: SAPS,NPA,DPSA,National Treasury, the Hawks, SIU,AFU and SARS. • In January 2012 the SIU was requested to render assistance in matters concerning non-compliance with policies, directives and legislation in relation to supply chain management and disciplinary matters. • The SIU and the NPA then met with the DPSA to discuss the distinction between the disciplinary hearings and the criminal matters emanating from these investigations and how these would be handled.

BACKGROUND CONT........... • The institutional arrangement agreed to handle disciplinary cases emerging from this process is the following: • The SIU and/or Forensics Firms investigate matters, • hand over the investigation reports to the DPSA to pursue disciplinary action and • the NPA to pursue criminal action. • The DPSA, once ceased with the reports, must examine whether any officials are identified as having committed acts of misconduct. • This includes amongst others: • Officials trading with their own departments, • Annual financial disclosures by SMS members(non disclosure or incorrect disclosures), • Officials conducting remunerative work outside public service and • Any other acts of misconduct identified during investigations.

MANAGEMENT OF DISCIPLINARY CASES CONT… • 303 cases were referred to the SIU and Forensic Firms for investigation • The SIU forwarded to the DPSA 41 cases which it had investigated • In addition, 47 cases were received from the Forensics Firms during the Month of June 2013 • 18 cases have been finalized (Department of Health 11 and Treasury 7) • Cases as per Department: • Department of Health( TOTAL 26), • Department of Education( TOTAL 21), • Department of Public Works( One senior official put on precautionary suspension while the DPSA investigates .( TOTAL 13), • Provincial Treasury( TOTAL 16), • Department of Roads and Transport( no cases were submitted to the DPSA), and • Cooperative Governance Human Settlements and Traditional Affairs.( TOTAL 12)

MANAGEMENT OF DISCIPLINARY CASES CONT… • 2 HoDs were handed precautionary suspension letters and charged by the Premier. • The total number of cases handed over to the DPSA by the both the Forensic Firms and the SIU is 88. • The are 44 SMS members charged( the number includes the 2 HoDs) and 44 junior staff members. • 41 relate to Remunerative Work Outside the Public Service and contravention of Section 30 of the PSA. • 47 relates high priority cases which is fraud and corruption.

  8. WAYFOWARD • SIU to speed up the completion of investigations. • SAPS to inform the DPSA in time of any possible cases of misconduct against officials who are facing criminal investigations before making arrests. • To finalize matters within 60 days.
