  1. Clay County Redevelopment Commission

  2. Background • Any city, town, or county may establish a redevelopment commission which will have jurisdiction over the Special Taxing District created within the boundaries of the unit. • The redevelopment commission may enter into a contractual relationship with any city or town within Clay County to act as the redevelopment commission for that entity.

  3. Purpose • Planning and development of blighted areas. • Clearing, re-planning, and development of blighted areas. • To serve as the single point of contact for county economic development prospects. • To serve as the agents, as directed, of the Clay County Board of Commissioners and Clay County Council.

  4. Organization • Commissioners must be at least 18 years of age and reside in the county. • No commissioners may have a financial interest in any matters dealt with by the commission. • The commission is made up of five commissioners appointed by the County Board of Commissioners.

Powers of the Redevelopment Commission • Declaration of eminent domain in blighted areas. • Levying of taxes in the Special Taxing District or any section within the District. • Declaration of eminent domain in blighted areas. • The power of eminent domain may only be used for redevelopment projects.

  7. Powers of the Redevelopment Commission • Designation of blighted areas or economic development areas and designation of all or part of these areas as tax allocation areas. • Acquisition by purchase, exchange, gift, grant, condemnation, or lease, personal or real property for the redevelopment of blighted areas.

  8. Powers of the Redevelopment Commission • Preparation of redevelopment and economic redevelopment plans.

  9. Powers of the Redevelopment Commission • Issuance of Special Taxing District Bonds payable from taxes, TIF, project revenue, and other available sources or combination thereof.

  10. Powers of the Redevelopment Commission • Can enter into lease financing arrangements to lease projects that can be funded or financed through TIF revenue. • Can sell, lease, or grant interests in real property acquired for redevelopment purposes to any governmental agencies.

  11. Powers of the Redevelopment Commission • Can repair, maintain, remodel, rebuild, or make major structural improvements on structures acquired for redevelopment purposes.

  12. Powers of the Redevelopment Commission • Can contract for construction of: • Local public improvements. • Structures necessary to support redevelopment or economic development areas. • Any structure that enhances economic development efforts.

  13. Powers of the Redevelopment Commission • Can accept grants or loans or other forms of financial assistance from any source. • Can enter into developer agreements and taxpayer agreements in an allocation area. • Enter into a contractual agreement to act as redevelopment commission on behalf of any incorporated city or town within the county.
