ORGANIZATION • The party takes part in the elections as a voluntary association (va) PARTY forDIRECT DEMOCRACY - P2D The name with which the party will take part in the elections is yet to decide and has to comply with legal restrictions (13 – 18 characters, depending on the law in force at that moment). It could be, for example, SENATE.P2D.BE • The party works together with the task force CITIZENS forDIRECT DEMOCRACY which is part of DEMOCRATIE.NU vzw-asbl

  3. MOTIVATION • An association which takes part to elections becomes a “political party” • Political parties have to comply with legal obligations. For example : In order to receive government dotations the party has the obligation to state in its statutes that it will comply with the European Declaration of Human Rights.

  4. VA / VZW-ASBL • In a VA all the members own the association and they share, in person and equally, both assets and responabillities. They may give mandate to administrators • In a VZW-ASBL the association is a juridical person on his own. The assets and responsabilities belong to the VZW-ASBL. There are legal obligations.

  5. MEMBERS of the VA: two conditions • One can become a member of “Citizens for Direct Democracy” VA, if : • one is a member of Democratie nu – vzw/asbl. • One holds a mandate within the vzw/asbl (chair, secretary, treasurer,..) or is an elected representative of the party, or is a candidate to one of those functions. • Exception : The founders

VOTING RIGHTS in the VA • All members with voting rights of Democratie.nu – vzw/asbl have voting rights in the assemblies of the “Citizens for Direct Democracy” VA, except for voting on the accounts and the budget of the VA, the mandates of the administrators and agreements with third parties. For these exceptions only the members of “Citizens for Direct Democracy” VA have exclusive voting rights.

  7. FINANCES 1 • If “Citizens for Direct Democracy” VA is considered for government dotation, a financial VZW/ASBL has to be established. This is a legal obligation.(w 4juli 1989) • Membership of this vzw/asbl is reserved to members with voting rights of Democratie.nu – vzw/asbl

  8. FINANCES 2 • Financial activities which are related to the political action and which are not covered by the legal arrangement must be put in a special account within the task force “Citizens for Direct Democracy” Democratie.nu – vzw/asbl

Separation of Powers • Whitin the political organization we seek explicitly to maintain separation of powers. • Decision rights in finance and mandates are deliberately divided. • It belongs to the members of Democratie nu – vzw/asbl to take care of this separation of powers and to guarantee that the practices of thepolitical wing stays in agreement with the principles of Direct Democracy"

  10. Responsability • The placement of the mandates in a VA and the financial activities in a VZW/ASBL makes maximal use of these forms of organizations.
