  3. Participation of ENP Partners in EU Agencies and Programmes Objective of the ENP to enable partners to take part in various forms in EU agencies and programmes, in order to support reforms and approximation to EU norms and standards. PARTICIPATION IN EU PROGRAMMES AND AGENCIES 1

Participation of ENP Partners in EU Agencies and ProgrammesContext (I) Objectives: • Support ENP partners’ economic and social transition. • Encourage and support regulatory and administrative reforms and institution building. • Contribute to the reform and modernisation process. • Promote convergence towards EU norms and standards, exchange of best practices, know-how and networking.   5. Participation of ENP Partners in EU Agencies and ProgrammesContext (II) Gradual approach: identification of the Agencies and Programmes on a case-by-case basis. Participation of ENP Partners in EU Agencies and ProgrammesContext (IV) General methodology: Commission Communication to enable ENP partner countries to participate in Community agencies and Community programmes’(December 2006). EU Council endorsed the Communication (March 2007): ‘Support for the general and gradual approach outlined in the Communication to enable ENP partners to participate in Community agencies and Community programmes on their merits and where the legal bases so allow’. Participation of ENP Partners in EU Agencies and ProgrammesContext (V) ENP Joint Communication ‘A New Response to a Changing Neighbourhood’(May 2011): • ‘Facilitate partner countries’ participation in the work of selected EU Agencies and Programmes’. • ‘Support partner countries in fulfilling the legislative pre-requisites for participating in EU agencies’. • ‘Provide support for covering some of the associated costs of participation’. ENP Council Conclusions (June 2011):‘The EU will facilitate partner countries’ participation in EU programmes and agencies’. 6 PARTICIPATION IN EU PROGRAMMES AND AGENCIES

Participation of ENP Partners in EU Agencies and ProgrammesContext (VI) The Joint Communication ‘Delivering on a new European Neighbourhood Policy’ (May 2012) has underlined the importance of strengthening the EU support to the participation of partner countries: • New protocols enabling the participation in EU programmes will be negotiated. • A project supporting EU agencies to facilitate the participation of partners in their work is being elaborated. • Partners can have access to EU funds to co-finance their participation in EU programmes. 7 PARTICIPATION IN EU PROGRAMMES AND AGENCIES

Participation of ENP Partners in EU Agencies and ProgrammesAgencies (I) Agency: « Independent legal entity created by the EU legislator to help regulate a  particular sector at EU level and/or help implement a particular EU policy » Types of agencies: -Regulatory: assist the Commission in shaping new rules and monitoring the implementation of existing ones: European Aviation Safety Agency (EASA) -Operational: coordination of EU Member State joint operations: FRONTEX -Informational: assist Member States in analysis, assessment and provision of scientific information and data: European Environment Agency (EEA) PARTICIPATION IN EU PROGRAMMES AND AGENCIES 8

Participation of ENP Partners in EU Agencies and ProgrammesAgencies (II) Modalities and procedure of cooperation / participation Conditions for participation laid down in the Agency’s founding Regulation. Negotiation of concrete arrangements for participation of individual ENP partners. Participation of ENP Partners in EU Agencies and ProgrammesAgencies (III) Modalities and procedures for cooperation / participation (continued) Drawing-up a bilateral agreement on a case-by-case basis for each Agency. Council approval required before signature of each bilateral agreement and Parliament assent. Right of the ENP partner to become observer of the Agency: no voting rights on Management Board of the Agency . 11 PARTICIPATION IN EU PROGRAMMES AND AGENCIES

Participation of ENP Partners in EU Agencies and ProgrammesAgencies (IV) Level of possible participation varies between the agencies: • Cooperation: some Agencies allow for de jure ‘cooperation’ with the competent authorities in third countries • Community Fisheries Control Agency (CFCA): control and inspection cooperation in the framework of agreements concluded. • Participation: de facto gradual building-up from technical cooperation to full participation. • European Aviation Safety Agency (EASA): from Working Arrangement to full participation for countries adopting Chicago Convention and EU aviation safety rules. Participation of ENP Partners in EU Agencies and ProgrammesAgencies (V) Examples of cooperation: • Participation as an observer, upon signature of bilateral agreement: • European Aviation Safety Agency (EASA). • Other cooperation forms: Working Arrangement can be approved signed by the Agency’s Management Board and the corresponding body from the ENP partners, if the Agency’s legal basis allows . • FRONTEX Working Arrangement with Border Guard Service of an ENP partner. Participation of ENP Partners in EU Agencies and ProgrammesAgencies (VI) Examples of cooperation (continued) • Ad hoc participation, expert committees, seminars: • Community Plant Variety Office (CPVO): Invitation of observers from third countries to its meetings. • Participation in information activities and national information networks: • European Monitoring Centre on Drugs and Drug Addiction (EMCDDA): Technical contacts with ENP partners. • Informal collaboration on specific issues: • European Centre for Disease Prevention and Control (ECDC): Assistance to Ukraine after outbreak of avian influenza in 2009. Participation of ENP Partners in EU Agencies and ProgrammesAgencies (VIII) Arrangements signed between ENP partners and EU Agencies: • European Aviation Safety Agency (EASA): technical cooperation arrangements with Armenia, Azerbaijan, Georgia, Israel, Moldova, Morocco and Ukraine. • FRONTEX: Working Arrangements on operational cooperation concluded with border guard services of Armenia, Georgia, Moldova and Ukraine. • European Centre for Monitoring on Drugs and Drug Addiction (ECMDDA): MoU signed with Ukraine. Participation of ENP Partners in EU Agencies and ProgrammesProgrammes (I) Programme: “Integrated set of action adopted by the EU to promote cooperation between Member States in different specific fields, over several years, to achieve the goals of the EU”. • Originally conceived for the benefit of EU Member States – not to be confused with external assistance programmes, aimed specifically to support third countries (ENPI ). • In addition to state actors, EU Programmes in various sectors benefit non-state actors (individuals, enterprises, research institutes): Erasmus Mundus, Tempus, Seventh Framework Programme. Participation of ENP Partners in EU Agencies and ProgrammesProgrammes (II) Most of the existing EU programmes expire in 2013 (at the same time of the EU financial perspectives): • Examples: • Hercule II (financial control) • Public Health Programme (2008-2013) Follow-up EU programmes currently being negotiated under the new financial perspective (2014-2020): • Examples: • Hercule III (financial control) • Health for Growth (2014-2020) PARTICIPATION IN EU PROGRAMMES AND AGENCIES 22

Participation of ENP Partners in EU Agencies and ProgrammesProgrammes (III) Categories of EU Programmes: • Open for full participation: • SESAR Programme and Joint Undertaking • Competitiveness and Innovation Programme (CIP) • Open for participation in certain activities: • Fundamental rights and Justice general Programme • Interoperability Solutions for Public Administration (ISA) • Not open for participation to ENP partners: • LIFE+ (environment) but Proposal for the new financial perspective foresees the opening of the Programme for ENP partners’ participation. Participation of ENP Partners in EU Agencies and ProgrammesProgrammes (IV) Modalities and procedures for participation: • Conditions for participation laid down in the legislative basis establishing the Programme. • Protocols enabling participation are attached to the legally-binding agreements between the EU and ENP partners. • Southern Mediterranean countries: Association Agreements • Eastern Partnership countries: Partnership and Cooperation Agreements and subsequent Association Agreements. Participation of ENP Partners in EU Agencies and ProgrammesProgrammes (V) • Memorandum of understanding (MoU) laying down the detailed terms and conditions for the participation in a specific programme, to be negotiated with the relevant Commission DG. • Right of ENP partner to participate as an observer in Programme management committees. 25 PARTICIPATION IN EU PROGRAMMES AND AGENCIES

Participation of ENP Partners in EU Agencies and ProgrammesProgrammes (V) A form of participation in programmes may be possible without a protocol to the bilateral agreement or MoU: Example: 7th Framework Programme of Research and Technological Development: • Research institutions can apply for funding as partners with other institutions from EU Member States. Participation of ENP Partners in EU Agencies and ProgrammesConditions for participation in EU Programmes (I) In some cases, adoption of relevant EU acquis or international norms: • Media 2007 Programme: EU Directive of Audiovisual Services • Culture 2007 Programme: Ratification of UNESCO Convention on the protection and promotion of cultural expression. Financial contribution for participation varies depending on the Programme. EU ready to cofinance the costs of participation (ENPI or ENI in the future) on a limited in time and decreasing basis. Participation of ENP Partners in EU Agencies and ProgrammesConditions for participation in EU Programmes (II) No fixed formula: based on criteria such as: • GDP (Gross Domestic Product) of the EU and the ENP partner • Population • Specific criteria:GIEC (Gross Inland Energy Consumption): used in the CIP - Intelligent Energy Europe Programme. Calculated on the basis of the latest statistical data for the year from EUROSTAT. PARTICIPATION IN EU PROGRAMMES AND AGENCIES 30

Participation of ENP Partners in EU Agencies and ProgrammesProgrammes: protocols and MoU (I) Protocols and MoUs signed between ENP partners and the EU: • Protocols signed with Armenia, Israel, Jordan, Moldova, Morocco and Ukraine. • Protocols under negotiation with Algeria, Azerbaijan and Georgia. • Memoranda of Understanding concluded: • CIP – Competitiveness and Innovation Programme (EU-Israel, 2007). • 7th Framework Programme for Innovation and Research (EU-Israel, 2007; EU-Moldova, 2012).
