ASSESSMENT TASK ONE • Understanding relevant forms • Ensure you familiarise yourself with different stages • Ensure you review and understand the form content • Civil procedure forms– use this site to access the different forms • SCENARIO ASSIGNMENT – CIVIL FORMS • Scenario one: commencing proceedings • Scenario two: defending proceedings • Scenario three: witness to proceedings • Scenario four: evidentiary proceedings • Scenario five: defending proceedings

  4. SCENARIO ASSIGNMENT – CIVIL FORMS • Scenario one: commencing proceedings • You have been injured in the line of duty and are unable to work for at least 12 months. The police service/force you are working with does not approve your claim for compensation and you file a personal injury claim. Which commencement form will you choose and why? Provide an overview of the sort of information you would think you would need to consider for the completion of the form. You face a loss of wages of $52,000 plus medical expenses totalling $150,000. Which court will you file in and why?

SCENARIO ASSIGNMENT – CIVIL FORMS • Scenario two: commencing proceedings • Your neighbour has filed a claim against you for parking the police car on their grass and therefore ruining their garden. The claim is for $12,000. Which defence form will you file and why? What sort of content will you include to complete the form? Which court will you file with and why? • Scenario three: witness to proceedings • Your partner has accidentally knocked an offender’s head on the police car during an arrest. The offender has now filed a civil suit for damages. You have been asked to complete an affidavit as part of the interlocutory process, since you witnessed the event. What sort of information will you include and why? Explain your understanding of the purpose of an affidavit.

  6. SCENARIO ASSIGNMENT – CIVIL FORMS • Scenario four: evidentiary proceedings • There are some difficulties at your station and civil suits have been filed. You have been issued with a Subpoena to attend to give evidence. Explain your understanding of what this means you now need to do? What sort of information will you need to provide? What would be different if you had been issued a Subpoena to produce? • Scenario five: defending proceedings • An offender claims that you failed to secure his wallet when you arrested him for drunk and disorderly behaviour. As such, he has lost $2000 and files a claim in the Small Claims Tribunal for reimbursement. You have received a Form 3B Statement of claim. What would be the best defence form to file, and why? What sort of information would you need to include?
