Regulatory Update • SW Planning & Recycling Regs9 VAC 20-130 • Fast Track Amendment • Updates definitions; • Reorders regulatory sections; • Moves requirement for planning units to maintain/update SWMPs to a stand alone section; • Clarifies major and minor amendments to a SWMP; • Clarifies recycling rate calculation; and • Revises recycling rate credits language to be consistent with §10.1-1411 C of the Code of Virginia. Regulatory Update • Regulated Medical Waste Regs9 VAC 20-120 • A NOIRA will be published this month • Reorganize to match VSWMR layout • Clarify standards for RMW Generators and Permitted Transfer/Treatment facilities • Address Highly Infectious Waste (i.e. Ebola) • Intend to hold a focused RAP

Composting Exemption Guidance • Clarifies the permit-exempt types of composting • Extends interpretations of some exempt composting types: educational exemptions, pilot projects, composting at universities, one-time composting • Allows agricultural exempt operations under 9 VAC 20-81-397 to accept Category 1 wastes, not just vegetative • Soon to be sent out for comment • DPOR update—All compost facility operators need Class 1 license (includes MSW composting)

Landfill Gas GuidanceGM 2017-01 – signed September 5, 2017 • Clarifies expected DEQ compliance response to various LFG scenarios • In response to an exceedance (action or compliance level) • Clarifies required reporting (24-hr vs 5-day) • Standardizes an enhanced monitoring frequency • Requests evaluations of existing LFG network • Sets timelines for return to compliance • Sets minimum information in an Alternate Gas Source Demonstration

Landfill Gas GuidanceGM 2017-01 – signed September 5, 2017 • Implementation: • Compliance related changes enforced as of Jan 1, 2018 • LFGMP + LFGRP – update to SI-13 during the next revision of the respective plan. • LFGMP + LFGRP currently under DEQ Review - the plan should be revised to follow the revised SI-13 prior to DEQ approval and permit modification.

UECA Update • Uniform Environmental Covenants Act • Imposes activity and use limitations on contaminated property through environmental covenant • Applicability to Landfills addressed in FAQ: http://www.deq.virginia.gov/Portals/0/DEQ/Land/Guidance/UECA.pdf • DEQ has executed 4 UECAs at Solid Waste sites for GW, 2 additional in process

  16. Recycling Update • Progress made on developing electronic submittals for RR Report • Completion of this will facilitate a combined SWIA and Recycling Rate Report

Litter Prevention and Recycling Grants • DEQ provides funds for litter prevention and recycling grants to localities under a non-competitive grant program based on population and road miles. • Annual taxes are collected through a Litter Tax, Excise Tax on Soft Drinks, and Excise Tax on Beer and Wine Coolers. • Taxes are deposited into Litter Control and Recycling Fund • Since 1981, Virginia businesses have contributed over $54M to the fund to support local government litter control and recycling programs

Annual SWIA Report • Information on Solid Waste management is submitted by all permitted facilities annually. • This information is used to prepare the Solid Waste Information Assessment Report • Information for 2017 has been submitted and being compiled into the report which will be released June 30, 2018

  24. Solid Waste Compliance • 749 Site Inspections • 15 Record Review Inspections

Compliance Assistance • Staff have been providing compliance assistance to landfills regarding 3 day cover soil stockpiles to ensure material is capable of suppressing fires, i.e. already excavated (not in a borrow pit), reasonably close to the working face, and managed to control storm water runoff • 24-hr/5-day reporting guidelines are being finalized and example list of items requiring notification will be posted online & distributed to permittees during upcoming inspections
