Enforcement Issues • Everybody needs $$$ • EPA investigates non-reporters, suspected inaccurate reports, facilities that fail to report releases…. • EPA uses enforcement to assure compliance • LEPC help needed to maintain compliance before EPA steps in. • Facilities can reduce or eliminate potential penalties if they follow EPA’s Small Business Compliance Policy (≤ 100 employees) or EPA’s Audit Policy (> 100 employees).

Agribusiness & Farmers • LEPCs can help distribute Anhydrous Ammonia Fertilizer pamphlet to all agribusinesses and farmers. • Encourage immediate use of EPA’s Small Business Compliance Policy to mitigate penalties. • Farms/agribusinesses with ≥ 500 lbs anhydrous ammonia used for refrigeration must submit the annual Tier Two report in addition to requirements in pamphlet.

Managing Farms in Tier II Manager • LEPC becomes a “facility user” in Submit Module • Access to all farms in county • Talk to farmer and then… • Update information at any time to add or delete farms on 302 list • Input lat-long coordinates • Input chemical data • Instructions for LEPCs to Manage Farms on MSP-EMHSD web site

  5. Lat-Long Coordinates • Google & Yahoo engines sometimes yield different results • Tier II Manager submit module includes a lat-long lookup utility. Also, “Resources” at top of page in the program has Google and Yahoo links to lat-long searches • Learn how to find lat-long coordinates using MARPLOT

Planning for Farms • SARA Requirements are the same for all sites, including farms – those that have an EHS above the TPQ on site for any length of time require a community response plan • Plan development guidance is on the EMHSD website (See Resources slide for info) • Excellent farm emergency planning guidance is available from MSU-E, but LEPCs must add a small amount of info to make the plans compliant with SARA Title III. (See Resources slide for MSU-E info) • The Groundwater Stewardship program (MDA) coordinates with MSU-E on the Farm Tube Program

Hazardous Materials Emergency Preparedness (HMEP) Grant • Similar process as in previous years (application sent first, then contract developed and sent out) • Verification required for “Support Grant” reimbursement • Contract will now be in a similar format as other EMHSD contracts • Emphasis remains on completion of new community response plans (any extra funds in the grant are used to increase the payment for completing new plans)
