REGULATION EC 1071/2009 • NEW REGULATION EC 1071/2009: shall apply with effect from 4 december 2011 • NO IMPLEMENTATION IN NATIONAL LAW NECESSARY • STILL MANY SCOPE FOR POLICY-MAKING FOR THE MEMBER STATES: member states (for example Belgium) are preparing national regulation (c) IRU Academy 2011

  4. A. REGULATION EC 1071/2009 • SCOPE: > 3,5 tonnes, member states may lower this limit • TRANSPORT MANAGER: - new definition:the person who effectively and continuously manages the transport activities of the firm - (excisting) engagement requirements clearly described (c) IRU Academy 2011

REGULATION EC 1071/2009 • ENGAGEMENT REQUIREMENTS: - be of good repute: minimum conditions are prescribed, NEW is a list of most serious infringements (annex IX) - have appropriate financial standing: no changes - have the requisite professional competence - NEW: the operator shall have an effective and stable establishement (address) in a member state (c) IRU Academy 2011

REGULATION EC 1071/2009 • HAVE THE REQUISITE PROFESSIONAL COMPETENCE: - knowledge of the subjects demonstrated by a compulsory written examination involving two tests (written theory and written exercises), a supplementary oral examination - NEW: examination in the state where the candidate lives - conditions to pass (passing rate) - examinations organised by an authority or body that is duly authorised for this purpose by a member state, NEW: added that member states shall regulary verify those bodies (c) IRU Academy 2011

REGULATION EC 1071/2009 • HAVE THE REQUISITE PROFESSIONAL COMPETENCE: - prior training is possible, NEW: added that member states may duly authorise bodies to provide training and that member states shall regularly verify those bodies - NEW: possibility of periodic training at 10-year intervals (transport managers) - NEW: possibility of retraining (persons who possess a certificate of professional competence, but who have not managed a road haulage firm in the last 5 years) (c) IRU Academy 2011

  10. B. DRAFT CONCLUSIONS CPC MANAGER SURVEY • 1. REACTIONS • 26 people took the survey. They were from 20 different countries(Spain, Republic of Kosovo, Netherlands, Poland, Latvia, Portugal, France, Republic of Serbia, Hungary, Denmark, Romania, Finland, Slovakia, Belarus, United Kingdom, Czech Republic, Bulgaria, Iran, Bosnia and Herzegovina, Belgium) • The number of people that completed the survey thorougly is 19 (73 %) • Of the questionnaire results, 56 % were from the Freight transport industry and 44 % were from the Passenger transport industry, with most participants choosing to answer the questionnaire on both (c) IRU Academy 2011

GENERAL • Situation in Europe: The draft conclusions of the IRU Academy – Eurotra Survey on CPC Manager show that it whilst there is one directive/regulation, the organisation of the training and the exam is very different both in terms of content and format (c) IRU Academy 2011

TRAINING TOPICS • Is accreditation by competent authority necessary in order to run CPC Manager Courses in your country?(out of 22 reponses: 59 % accreditation necessary to run CPC Manager Courses) • CPC Manager Training mandatory (out of 22 responses: 59 % CPC Manager Training mandatory) (c) IRU Academy 2011

TRAINING TOPICS - Training topics: of the 19 respondents, the following CPC Manager topics were listed as mandatory:civil law, commercial law, social law, fiscal law, business and financial management, access to the market, technical standards and technical aspects and road safety) • In most countries these training topics are regulated, in France and the UK the training topics are free (c) IRU Academy 2011

TRAINING TOPICS - In addition to these training topics, 4 respondents also mentioned that additional topics are also covered in their national CPC Manager training curriculum: • Marketing and advertising, promotion of services, Insurance; Driving and resting time, tachographs, Customs declaration and procedures, CMR convention, transportation of dangerous goods, ATP agreement (Latvia) • HIV & AIDS, Bioterrorism (Serbia) • People Management Health and Safety Environmental Management, taxation, contract law, contracts and conditions of carriage vehicle operations and taxation and costing driving licensing, drivers hours and records insurance traffic legislation ICT (UK) • Sea, Rail Transport, inco terms (Iran) (c) IRU Academy 2011

  17. B. DRAFT CONCLUSIONS CPC MANAGER SURVEY • 4. TRAINING CENTERS • Organisations entitled to conduct CPC Manager Training varies from 1 (Republic of Kosova, Slovakia and Belgium) to 170 (Spain). In most countries 1 or maximum 3 organisations are entitled. • Organisations entitled to run CPC Manager Exams varies from 0 (Finland) to 80 (UK). In most countries 1 or maximum 2 organisations are entitled (c) IRU Academy 2011

The cheapest cost is in Belarus (40,00 €) and the most expensive is in the Netherlands (3.500,00 €) • The average cost of exam is 196 €, being free of charge in 2 countries (Latvia and Belarus) and being includes on the price of the training in 1 country (Republic of Serbia) (c) IRU Academy 2011

TRAINING CENTERS • CPC Manager Training: language: • Majority of the training centers (15) run courses in 1 language • 2 training centers run courses in 2 languages (Rupublic of Kosovo (Albanian and Serbian) and Latvia (Latvian and Russian)) • 2 training centers run courses in 3 languages (Belgium (Dutch, French and German) and Bosnia and Herzegovina (c) IRU Academy 2011

TRAINING CENTERS • How is the CPC Manager diploma obtained: • Upon completion of training only: 2 • Upon completion of training and passing exam: 16 • Upon passing exam only: 3 • Cost for a CPC Manager Diploma: • The average cost is 36,00 € • In some countries it is free of charge and in 1 country it is included on the price of the training • The cheapest is in Bulgaria (2,00 €) and the most expensive is in Slovakia (169,00 €) (c) IRU Academy 2011

TRAINING: TYPE OF TRAINING • CPC Manager Training: type of training: • Majority (21) uses classroom training often combined with other forms, such as E-learning (8), other forms of distance learning (5) and self study (11) • In Finland, group studies are used (technical labs: digital tacho, voter reponse system: (multiple choise questions projected to screen for the whole group, answers by remote controls > group results seen instantly in %) (c) IRU Academy 2011

  23. B. DRAFT CONCLUSIONS CPC MANAGER SURVEY • 5. TRAINING: TYPE OF TRAINING • Classroom training: average class size is 18. It varies from 6 (Bulgaria) to 50 participants (Belgium) • Self-study as a training type, used in combination with periodic assessment: out of 11 respondents, (5) 45 % people said yes and (6) 54 % said no. • Total length (in hours) of CPC Manager Programme: the average of the total length is 114 h. It varies from 35 (UK) to 270 (Serbia) (c) IRU Academy 2011

TRAINING: TYPE OF TRAINING • Teaching hours per topic: for about 50 % of the training centers the teaching hours per topic are mandatory • Total number of instructors involved in CPC Manager Training at the training center: the average of total instructors is 22 per training center. EXAM CPC MANAGER • CPC Manager Exam: Who is involved in the design of the CPC Manager Exam: • 3 chose training center only (15 %) • 10 chose competent authority only (50 %) • 7 chose training center and competent authority (35 %) • If the respondent chose competent authority only: • 8 countries have an examination commission • 1 country does noet have an examination commission (c) IRU Academy 2011

EXAM CPC MANAGER • Components that are mandatory or voluntary in the CPC Manager Exam: majority combination of components (weight in percent differs from country to country) • Total examination time: variable, between 2,5 hours (Republic of Kosova) and 6 hours (Belgium) • The average passing rate of the CPC Manager exam: 67 %. It varies from 28 % (Spain) to 98 % (Republic of Serbia) (c) IRU Academy 2011

Course materials • Course materials: 21 out of 26 training centers design the entire CPC Manager Course • Course materials: majority (17) uses books often combined with folders (10). 7 centers use E-learning. • Course materials: other forms are: copies of regulation and case studies (Poland), presentations (Republic of Serbia), laptop and Power Point (Portugal), every trainer for his subject prepare for students presentation, laws, home tasks and other information (Latvia) (c) IRU Academy 2011

RESULTS IMPLEMENTATION REGULATION EC 1071/2009 • Implementation includes no mandatory training in Bulgaria, the UK, Poland, the Netherlands and the Czech Republic. For Iran also no mandatory training. • Implementation includes mandatory training in Spain, Belgium and Romania. For the Republic of Kosova, Bosnia and Herzegovina, Belarus and Serbia also mandatory training. (c) IRU Academy 2011

RESULTS IMPLEMENTATION REGULATION EC 1071/2009 • 6 responses (50 %) said that the national provisions will include periodic training and other 6 (50 %) said it won’t include it • In case of periodic training, this periodic training will differ from country to country (every 5 years or every 10 years) (c) IRU Academy 2011

RESULTS IMPLEMENTATION REGULATION EC 1071/2009 • With the upcoming implementation of EC 1071/2009 the training centers are not planning to make or will maybe make changes to the training, the periodic training, the diploma, the examination, the cours materials, the instructors and the pricing. • IMPORTANT REMARK: many training centers are waiting with changes until their national authorities have made propositions for the implementation. Many national authorities, for example Belgium, are preparing new legislation. (c) IRU Academy 2011

  31. B. DRAFT CONCLUSIONS CPC MANAGER SURVEY • 9. CONCLUSION • The criterias for the obtention of a CPC Manager vary a lot between the different countries. This is also applicable within the EU member states. It seems that despite a new regulation the differences will remain.“Tourism” is however going to be banned. • These are the following changes proposed: • training: number of hours, course content review and update • Examination: review exam types and make it more difficult • Course materials: review and update course materials • Instructors: updates in training and upskilling • Pricing is likely to increase (c) IRU Academy 2011
