  5. ICC – International Code Council • International Code Council is a member-focused association. It is dedicated to developing model codes and standards used in the design, build and compliance process to construct safe, sustainable, affordable and resilient structures.   6. ICC – International Code Council • The International Codes, or I-Codes, published by ICC, provide minimum safeguards for people at home, at school and in the workplace. The I-Codes are a complete set of comprehensive, coordinated building safety and fire prevention codes. ICC – International Code Council • Fifty states and the District of Columbia have adopted the I-Codes at the state or jurisdictional level. • Federal agencies including the Architect of the Capitol, General Services Administration, National Park Service, Department of State, U.S. Forest Service and the Veterans Administration also enforce the I-Codes. ICC – International Code Council • The Department of Defense references the International Building Code for constructing military facilities, including those that house U.S. troops around the world and at home. • Amtrak uses the International Green Construction Code for new and extensively renovated sites and structures. • Puerto Rico and the U.S. Virgin Islands enforce one or more of the I-Codes. ICC – International Code Council • 1994 non-profit organization dedicated to developing a single set of comprehensive and coordinated national model construction codes. • The founders of the ICC: • Building Officials Code Administrators International, Inc. (BOCA), • International Conference of Building Officials (ICBO) • Southern Building Code Congress International, Inc. (SBCCI). • Although regional code development has been effective and responsive to our country’s needs, the time came for a single set of codes. The nation’s three model code groups responded by creating the International Code Council and by developing codes without regional limitations; the International Codes.   11. ICC – International Code Council • Code Development: • Any interested individual or group may submit a code change proposal and participate in the proceedings in which proposals are considered. This open debate and participation before a committee of representatives from across the construction industry, including code regulators and construction industry representatives, ensures a consensus of the construction community in the decision-making process. ICC – International Code Council • A major advantage of ICC’s consensus-based • private-sector code development process is that it • allows both the ICC code development committees • and eligible voting members at the code change • hearings to participate in establishing the results of • each proposal. Voting members may either ratify the • committee’s recommendation or make their own • recommendation. The results of all votes are • published in the report of the ICC code development • hearings. ICC – International Code Council • Eligible voting members review the recommendations of the • code development committee and determine the final • action. • Followingconsideration of all public comments, each • proposal is individually balloted by the eligible voters. The • final action on the proposals is based on the aggregate • count of all votes cast. This process ensures that the • International Codes will reflect the latest technical • advancements and address the concerns of those • throughout the industry in a fair and equitable manner. IgCC – International Green Construction Code • 1st model code to include sustainability measures for the entire construction project and its site — from design through construction, certificate of occupancy and beyond. The new code is expected to make buildings more efficient, reduce waste, and have a positive impact on health, safety and community welfare. ACG 9th Annual Conference on total building commissioning

IgCC – International Green Construction Code • ICC collaborated with cooperating sponsors – • American Institute of Architects (AIA) and ASTM International (ASTM) on the initial development of IgCC Public Version 1.0. • AIA and ASTM played a vital role in the development of the IgCC: the AIA presence ensured a focus on their 2030 Carbon Neutrality Goal, while ASTM International, which carries a worldwide reputation as a standards developer, solidified the scientific basis behind the IgCC. • ASHRAE, the U.S. Green Building Council (USGBC) and the Illuminating Engineering Society (IES) joined the ICC/AIA/ASTM team in developing the IgCC. • ASHRAE Standard 189.1-2011 is included as an optional path to compliance within the IgCC. IgCC – International Green Construction Code • Model-Code Approach–communities tailor to meet local needs • Note: 189.1 is jurisdictional compliance option, however Cx is mandatory regardless of the compliance route chosen • 611.1.1 - Registered design professional OR approved agency • Approved Agency – An established and recognized agency regularly engaged in conducting tests or furnishing inspection services or commissioning services, where such agency has been approved (approved = acceptable to code official) ACG 9th Annual Conference on total building commissioning

IgCC – International Green Construction Code • 902.1.1 Commissioning professional is required to be “competent and independent” from contractor performing the work • Code states that IAS Accreditation ensures code official of the commissioning professional’s competence and independence • 611.1.4 Preliminary Cx report shall be certified (signed and sealed) and final inspection not allowed until building owner has received Preliminary Cx report and confirmed as such to the code official. Otherwise building will not get a Certificate of Occupancy • Table 903.1 – Checklist of Cx requirements from Erosion Control to Air Balancing, and reads that all 60+ items in the table must be addressed in the Cx Report ACG 9th Annual Conference on total building commissioning

ICC Commissioning Guideline • Written in compliance language, enforcement largely at discretion of code official • Each deliverable has requirements for contents (i.e. Cx Plan contents, BOD contents) • Essentially all building components included, but not necessarily performed by one commissioning professional • Evaluation criteria for Cx of each system type is defined in Section 5.0 of the guideline • This guideline is built very specifically to provide: • An overview of commissioning skillsets required to perform the duty • Roadmap for code official to enforce the commissioning process • Document can be adopted in whole or in part by AHJ, so in theory not all of the systems listed in Section 5.0 would be required depending on jurisdictional requirements • Implications tie in with those outlined for the IgCC ACG 9th Annual Conference on total building commissioning

IgCC – International Green Construction Code • Per IAS April 5, 2013 letter: • “To aid code officials in enforcing commissioning, the International Code Council (ICC) has published a Commissioning Guideline (ICC G4-2012). However, this guideline does not specify what is required when approving and accepting a commissioning agent/agency.” ACG 9th Annual Conference on total building commissioning

IAS – International ACCREDITATION SERVICES • The International Accreditation Service (IAS) provides objective evidence that an organization operates at the highest level of ethical, legal and technical standards. • IAS is a nonprofit, public-benefit corporation that has been providing accreditation services since 1975. It is a subsidiary of the International Code Council (ICC). • IAS accredits a wide range of companies and organizations including governmental entities, commercial businesses, and professional associations. IAS accreditation programs are based on recognized national and international standards that ensure domestic and/or global acceptance of its accreditations. IAS – International ACCREDITATION SERVICES • IAS is a signatory to the four primary international organizations that form a unified system for evaluating and recognizing competent accreditation bodies worldwide. These organizations are identified as “cooperations” because they have agreed to cooperate with one another by adhering to a common set of accreditation criteria and to undergo periodic onsite evaluation to determine ongoing compliance with ISO/IEC Standard 17011, General Requirements for accreditation bodies accrediting conformity assessment bodies (CABs). IAS – International ACCREDITATION SERVICES • “May 2012, the ICC G4 Committee, which • included regulators, requested that IAS • develop criteria for accreditation of entities • involved in certification and training of • commissioning agents, in order to aid • building officials with enforcement of code • mandated commissioning requirements.” ACG 9th Annual Conference on total building commissioning

IAS and AC476 • Establish criteria for obtaining and maintaining accreditation for commissioning training and certification organizations (if you credential in Cx, this means you) • Note: Does cover both training agencies AND personnel certification bodies • Commissioning professional defined in two ways: • Commissioning Provider of Record – Approved by AHJ to be responsible for building commissioning process • Commissioning Specialist (twelve categories from HVAC to Irrigation) – Certified party working under the Cx Provider of Record for specific technical area ACG 9th Annual Conference on total building commissioning

IAS and AC476 • Organizations must (in order for accreditation as a training agency) provide training in the following: • Cx process • Codes, standards, guidelines • Systems, equipment, components and verification of their performance • For personnel certifications, those organizations shall certify that: • Individual has thorough knowledge of Cx process • Knowledge of codes, standards, guidelines • Ability to verify system performance • Met their minimum requirements for education, work skills and experience • Personnel certifiers must also operate under a management system complying with ISO 17024 ACG 9th Annual Conference on total building commissioning

IAS and AC476 • AC476 defines options for educations requirements, work experience and examination (currently in Section 5.2 of the version available for public comment) • Two tables to distinguish between certification criteria for Cx Provider of Record and Cx Specialists • ISO 17024 – objective is achieving and promoting accepted benchmark for organizations operating certifications of persons • Could be applied to organizations for anything from commissioning to IT and more • By AC476, certification bodies will be required to be ISO 17024 certified which involves an initial certification and then annual audit and renewal • ISO 17024 certification requires: • Fairness among potential candidates • Policies for granting, maintaining, renewing and expending the certification • Organization must be INDEPENDENT and IMPARTIAL in relation to applicants ACG 9th Annual Conference on total building commissioning

Agent versus authority • Important to know and understand the legal differences • Authority – Individual cited as or appealed to as an expert (Webster’s) • Agent – One who is authorized for or in place of another (Webster’s) • What this means is that an agent does not work for the client but actually becomes the client. So the CxA would actually become the Owner in this instance contractually. This is not how commissioning contracts are typically written. • Essentially all of the Cx bodies providing certification of commissioning professionals have recognized the title of Authority or interchanges between Authority and other titles (i.e. Provider), but most do not call the professional a Commissioning Agent • Finally, IgCC identifies Approved Agency in lieu of Authority or Agent • Thanks to Jerry Kettler for his report on commissioning professional terms which was used to create this slide ACG 9th Annual Conference on total building commissioning

DCRA 1st Annual Green Symposium • District of Columbia • Department of Consumer and Regulatory Affairs • The mission of the Department of Consumer and Regulatory Affairs (DCRA) is to protect the health, safety, economic interests and quality of life of residents, businesses and visitors in the District of Columbia by ensuring code compliance and regulating business. The agency operates a consolidated permit intake center and reviews all construction documents to ensure compliance with building codes and zoning regulations.   46. Sample IgCC Code Mandated Commissioning Test 606.1.2.2 Testing requirement. The building envelope air tightness shall be considered to be acceptable where the tested air leakage is less than 0.25 cfm/ft2 (4.57 m3/hr/m2) when tested at a pressure of .30 in w.c. (75 Pa). Testing shall occur after rough in and after installation of penetrations of the building envelope, including penetrations for utilities, HVAC, plumbing, and electrical equipment and appliances.
