BASIC ACTS • Council decisions for two Framework Programmes • Framework programme "Security and Safeguarding Liberties" Specific programmes: • Prevention, Preparedness and Consequence Management of Terrorism and other Security related Risks(Council Decision 2007/124/EC, Euratom of 12 February 2007, OJ 24.02.2007, L 058, p.1) • Prevention of and Fight against Crime(Council Decision 2007/125/JHA of 12 February 2007, OJ 24.02.2007, L 058, p.7) • Framework programme "Fundamental Rights and Justice" Specific programme: Criminal justice(Council Decision 2007/126/JHA of 12 February 2007, OJ 24.02.2007, L 058, p.13)

BASIC ACTS – Policy framework • In February 2007 the basic acts replaced the AGIS Council Decision 2002/630/JHA of 22 July 2002 • Other relevant acts: • Treaty on European Union (i.e. Arts. 29 and 31) • The Hague programme (2004) • European Union Plan of Action on Combating Terrorism (2004) • EPCIP - Programme for Critical Infrastructure protection (2005) etc.

Prevention, Preparedness and Consequence Management of Terrorism and other Security related Risks Objectives The Programme shall contribute to support Member States‘ efforts to prevent, prepare for, and to protect people and critical infrastructure against terrorist attacks and other security related incidents. Areas concerned The Programme is intended to contribute to ensuring protection in the areas such as the crisis management, environment, public health, transport, research and technologicaldevelopment and economic and social cohesion, in the field of terrorism and other security related risks within the area of freedom, security and justice.

Prevention of and Fight against Crime • Objectives • The Programme shall contribute to a high level of security for citizens by preventing and combating crime, organised or otherwise, in particular terrorism, trafficking in persons and offences against children, illicit drug trafficking and illicit arms trafficking, corruption and fraud. • The Programme consists of four themes • crime prevention and criminology • law enforcement • (c) protection and support to witnesses • (d) protection of victims

Criminal Justice Objectives (a) to promote judicial cooperation with the aim of contributing to the creation of a genuine European area of justice in criminal matters based on mutual recognition and mutual confidence; (b) to promote the compatibility in rules applicable in the Member States (c) to improve the contacts and exchange of information and best practices between legal, judicial and administrative authorities and the legal professions, to foster the training of the members of the judiciary, with a view to enhancing mutual trust; (d) to further improve mutual trust with the view to ensuring protection of rights of victims and of the accused.

  11. Content of the Annual work programmes • Part A: Action grants (to be awarded through a call for proposal (transnational and national projects) • Part B: Operating grants (for NGOs) • Part C: Framework partnerships • Part D: Grants to bodies in monopoly situation • Part E: Public procurement

Action grants-common features • Transnational projects – 2 partners: • in at least two Member States, or • one Member State + one candidate country ********************************************************* • Third countries and international organisations may participate as partners, but are not permitted to submit projects.

Action grants-common features • National projects are eligible if they : • Prepare transnational projects and/or Union actions (starter measures) • Are complementaryto transnational projects and/or Union actions • Contribute to developing innovative methods at Union level • Develop such methods and technologies with a view to transferring them to other Member States

  14. Action grants-common features • Principle of co-financing • Maximum duration of 3 years (to be checked in the annual work programme) • Minimum amount for the grant 50.000 Euro (to be checked in the annual work programme)

Eligible activities shall aim at: • strengthening networking, mutual confidence and understanding, • development of contingency plans, exchange and dissemination of information, experience and best practice); • analytical, monitoring, evaluation and audit activities; • development and transfer of technology and methodology, particularly regarding information sharing and inter-operability; • training, exchange of staff and experts • awareness and dissemination activities.

Target groups • Access to the Programmes shall be opened to bodies and organisations with legal personality established in the Member states • law enforcement agencies • other public and/or private bodies, actors and institutions including local, regional and national authorities • social partners • universities • statistical offices • non-governmental organisations • public-private partnerships • relevant international bodies • legal practitioners • representatives of victims' assistance services, and other professionals involved in the work of the judiciary

  19. New forms of cooperation • Reasons: • more flexibility esp. in timing • long-term cooperation with key players • Forms • Framework partnerships • Grants to bodies in monopoly situations monopoly projects: exceptional, Art 168 IR ( EJTN, Europol)

  20. Framework Partnerships • In programmes: Criminal Justice and Prevention of and Fight against Crime • To provide for a long term cooperation with certain partners • Work on a regular and stable basis • The expected duration of the framework partnership agreements is 4 years.

  21. Framework Partnerships – Who can apply ? • Prevention of and Fight Against Crime: public authorities only • Criminal Justice : bodies and organisations with a European dimension in the area of training of legal professions, established in the Member States with legal personality.

  22. Grants to Bodies in a Monopoly situation and projects initiated and managed by the Commission with a European Dimension • Foreseen beneficiaries: EJTN, ATLAS, Europol, FIU-net,IAEA, CEN • Application for a grant must be sent to the Commission

  23. Public Procurement contracts • Contracts for activities such as: -studies -evaluations -impact assessments -development of software and web pages -conferences and meetings etc.

Call for Proposals: Prevention, Preparedness and Consequence Management of Terrorism and Security related Risks 2008 • Publication of Call for Proposals : November 2007 • Deadline: for submission: Feb./March 2008 • Budget: € 11,8 million • Activities: • Projects should have a potential for transferability at EU level in the field of security-oriented critical infrastructure protection and belong to one of the following sectors: Energy, Information Communication Technologies, Water, Food, Health, Financial, Transport, Chemical industry, Research facilities and General topics

Call for Action grants: Prevention of and Fight against Crime 2008 • Thematic priorities • Horizontal approaches and crime prevention measures such as: • prevention of organised crime and of general crime • protecting victims and supporting and protecting witnesses and other persons ready to co-operate with justice. • prevention of violent radicalisation and recruitment to terrorism • exchanges among law enforcement officials, training, seminars, sharing of knowledge and/or best practices • linguistic support activities

Call for operating grants: Prevention of and Fight against Crime 2008 • Operating grants may be awarded to NGOs: • active in the field of general crime prevention dealing with juvenile crime, urban crime or drug related crime, and facilitating different forms of restorative justice and mediation. • aiming at improving transparency and accountability of non-profit organisations in the European Union and thus contribute to the protection of these organisations against any abuse of financial criminal nature • aiming at preventing, at local level, the emergence of radicalising tendencies, and at developing mechanisms related to renunciation of violence and terrorism

  33. Call for Operating Grants proposals: Criminal Justice Programme 2008 • Deadline for submission of proposals: Jan/Feb 2007 • Budget: € 0,5 million • Co-financing of costs of functioning of NGOs that have been legally established in accordance with the law of one of the Member States

Call for Operating Grants Proposals: Criminal Justice Programme 2008 • The following activities will be given priority: • improving the professional skills of legal practitioners and defining training curricula; • cooperation between public authorities and associations in the field of victim assistance; • cooperation between public authorities and associations in the field of rehabilitation of offenders; • production and dissemination of information on how to access legal interpretation, translation and advice; • Cooperation between academics and researchers, and between them and EU institutions, in the area of judicial cooperation in criminal matters; • development of restorative justice and mediation; • networking of legal professions with a view to improving defence rights in cross-border cases.

Selection and evaluation process of the applications Eligibility criteria (sent before deadline, date and signature, all requested documents attached) Exclusion criteria (no situation of bankruptcy, signed declaration of honour) Selection criteria (operational, professional and financial capacity) Award criteria (quality of the content)

  36. Selection and evaluation process of the applications • Eligibility criteria in general: • bodies or organisations with legal personality established in the Member States. Profit oriented bodies must submit a declaration from its partner non-profit or state organisation. • relation to one of the general objectives of the programme • Correct application form (dated and signed) + all the documents listed the calls; • budget in Euro, balanced in income and expenditure. • The amount of Community funding requested may not exceed 70% of the total eligible costs of the project; it must include a minimum contribution of 30% of the total eligible costs of the project (from the applicant, partners, other sponsors and revenue)

Selection and evaluation process of the applications • Eligibility criteria in general: • Minimum grant € 50.000 (there may be also a maximum amount) • Transnational projects must involve partners in at least two Member States, or at least one Member State and one other State which is an acceding or a candidate country • Projects cannot be already completed and should not be scheduled to start before the signature of the contract • Projects cannot last more than three years. • The deadline for applications must be respected (as evidenced by a postmark).

  38. Selection and evaluation process of the applications • Exclusion criteria (in general): • Candidates must sign the declaration of honour on the last page of the application form to declare that they are not: • bankrupt or being wound up, or having their affairs administered by the courts • convicted of an offence concerning their professional conduct by a judgment which has the force of res judicata • guilty of grave professional misconduct proven by any means which the contracting authority can justify • the subject of a judgment which has the force of res judicata for fraud, corruption involvement in a criminal organisation or any other illegal activity detrimental to the Communities' financial interests • subject to a conflict of interest • guilty of misrepresentation in supplying the information required or fail to supply this information.

Selection and evaluation process of the applications • Selection criteria: • operational, professional capacity to conduct the proposed project (CVs of personnel involved etc.) • financial capacity (for private bodies only) (ability to manage the funds allocated, analysis of profit and loss accounts, balance sheets)
