Programme 3: Detective Services Purpose: Enable the investigative work of the South African Police Service, including providing support to investigators in terms of forensic evidence and the Criminal Record Centre.

All 20 Serious Crimes % Charges Court Ready No information is available for 2009/2010 due to the fact that it is a new Performance Indicator.
Utilisation of information • Quarterly Monitoring of the Detection Rate and Court Ready Cases are done. • This information is being used as an early warning system during station/cluster/provincial Crime Forum meetings to monitor progress in achieving targets, and to investigate any deviation from target. • Stations not achieving their targets are identified and interventions are implemented to assist such stations. • This also assist in liaising with public prosecutors to ensure speedy finalization of cases awaiting decisions on prosecution.
Females in the Detective Service An example of a case successfully managed by a female detective: Lansdowne CAS 127/6/2005 (Murder) - The so called “ baby Jordan- case”. A women hired three males to kill her boyfriend’s baby. Suspects were convicted and sentenced to imprisonment ranging from twenty-five (25) to fifty-five (55) years imprisonment. Case was investigated by Captain Bailey of SAPS Lansdowne Detective Service.
Criminal Justice System What Protocols are in place to sustain cooperation within the CJS Cluster Departments?What issues do these Protocols address? • Protocol on Maximum Incarceration Period - Section 49G of Correctional Service Amendment Act – Deals with procedure on how to deal with remand detainees - detained 24 months and longer. • Protocol on Section 49E – Referral of terminally ill or severely incapacitated remand detainees to court – deals with procedures and processes to be followed relating to the release of terminally ill or severely incapacitated remand detainees. • 49F – Release of detainees in custody of Police – deals with procedures to be followed when remanded detainees are temporarily released to SAPS for investigation purposes. • Procedures – Justice/Correctional Service/SAPS on how to deal with Foreign Nationals. • Protocol on Remand detainee Foreign National - Deal with the procedures to be followed with foreign nationals as remand detainees. • Bail Protocol – Deals with processes relating to granting bail. • Pre-Trial Protocol – Deals with the placement of matters on the court roll. • Regional Court Screening Roll – Deals with placement of DCCO’s at courts to screen dockets. • Court Protocol – Deals with court case management. • Mental Observation Protocol – Deals with processes to follow with accused send for mental observation. • Post Mortems & Tocsicology analysis Protocol – Deals with finalization of exhibits for forensic analysis.
Sentences Sentences • Jeppe CAS 1089/09/2008 (House Robbery) and eleven other house robbery case, Jeppe CAS 29/07/2009 (Murder) and 4 x cases of possession of unlicensed firearms and ammunition. • During September 2008 and September 2009 a spate of house robberies took place in the Jeppe policing precinct in Johannesburg. Two (2) males brutally attacked and robbed elderly people in Kensington and Bezuidenhout Valley. Two (2) brothers, BonganiMoyo and ThulaniMoyo were arrested by a team of detectives of Jeppe SAPS. Both were convicted on : • One (1) count of murder • Eleven (11) Counts of house robbery • Four (4) counts of possession of unlicensed firearms and ammunition. Sentences : • BonganiMoyo – Life Imprisonment, plus 197 Years Imprisonment • ThulaniMoyo – 167 Years Imprisonment
Sentences… • Pietermaritzburg CAS 41/05/2009 Count (1) – robbery, Counts (2,3,4,8,9,10,11,12,13,14) – Rape, Counts (5,6,7) - Accomplice to Rape The complainant and her boyfriend were walking along the road when they were approached by seven males who forcefully grabbed her and took her away, they then robbed her of her handbag and forced her to lie down where she was raped by three males who each raped her twice, the other four males left prior to the rape.
Sentences Pietermaritzburg CAS 41/05/2009 • Count (1)- not guilty • Count (2 to 7 ) – 6 life imprisonment • Count (8 to 10) - not guilty • Count (11 to 13) – 3 life imprisonment • Count (14) - not guilty
