  2. Aim: • To provide an awareness of the Road Safety Framework for Scotland and highlight our approach to tackling drink driving.

  3. Vision • “A steady reduction in the numbers of those killed and those seriously injured, with the ultimate vision of a future where no-one is killed on Scotland’s Roads and the injury rate is much reduced”

  9. Tackling Drink Driving

  10. Legislation • Road Traffic Act 1988, section 5: • Drive, attempt to drive, or be in charge of a motor vehicle on a road or other public place whilst the proportion of alcohol in your breath, blood or urine exceeds the prescribed limit. • Applies GB wide

  11. A Constable can require any person who they have reasonable grounds for believing is or has been: driving, attempting to drive or in charge of; a motor vehicle; on a road or other public place when the constable suspects that the driver has; alcohol in their body, has committed a moving road traffic offence or who has been involved in a collision; to provide a specimen of breath for a breath test. It is an offence to fail to provide a specimen of breath for a breath test without reasonable excuse. Police Power to Require a Breath Test

Penalties • If someone is charged and found guilty of a drink driving offence, in addition to a criminal record, the following penalties may apply; • Driving or attempting to drive – 6 months imprisonment, up to £5000 fine & a driving ban for at least 1 year (3 years if convicted twice in 10 years). • Refusing to provide a specimen of breath, blood or urine for analysis – 6 months imprisonment, up to £5000 fine, a ban from driving for at least 1 year. • Causing death by careless driving when under influence of drink – 14 years imprisonment, unlimited fine, a ban from driving for at least 2 years.

Reduced limit introduction • Following transfer of the power to set drink drive limit from Westminster to Scottish Parliament, the Scottish Government published consultation paper, “Reducing the Drink Driving Limit in Scotland” • Consultation ran from 6 September to 29 November 2012 • 138 responses • Thereafter: During October 2014 Scottish Government officially announce (pending approval of Parliament) plans to introduce drink drive limit • As a result……

  15. New Limits (Scotland) • 22 microgrammes of alcohol in 100 millilitres of breath • 50 milligrammes of alcohol in 100 millilitres of blood • 67 milligrammes of alcohol in 100 millilitres of urine.

  16. Consistent Media Message • “It is clear, when it comes to drinking and driving, that the simple 'the best advice is none' message is the right one.”

  17. Results • Festive Drink Drive Campaign 2014/15 • 351 Detections (434 in 13/14) • 19% reduction • Prosecutions (COPFS Snap-Shot) • 6/12/13 – 23/2/14 (Old Limits) – 739 • 6/12//14 – 23/2/15 (New Limits) – 491 • 33.5% reduction. • However………..

  18. Results • Festive Drink Drive Campaign 2015/16 • 459 Detections (351 in 14/15) • 30.8% increase. • Festive Drink Drive Campaign 2016/17 • 625 Detections • 36% increase.

  19. Success? • Drink Driving - Scotland (Management Information Figures) • - 6.8 %

  21. Results: Caught in the Gap • Festive period 2014/15 = 20 (351) • Festive period 2015/16 = 19 (459) • 42 cases from total of 491 prosecuted by COPFS between 6/12/14 & 23/2/15 were over new but under old limit.
