  2. Discipline Reporting • Required by both State and Federal Law • TEC 37 defines legal procedures • PEIMS Data Standards define coding • Discipline data is reported in the Summer PEIMS Submission • Discipline coding effects State and Federal Accountability

  3. When to create a discipline incident in TXEIS • Any discipline action that removes a student from a class or classes, for any part of a day, must be reported to TEA via PEIMS • If the discipline action taken meets the above criteria a discipline incident must be entered into TXEIS

  4. What information should be reported? • The Discipline Action Reason which indicates why the student is in trouble • The Discipline Action which indicates what punishment is being given ISS, OSS, DAEP, or JJAEP • The Behavior Location which indicates whether the incident happened on/off campus, at a school related activity, etc. • The length of the discipline action(s) • The date of offense (incident date) • All offenders involved in the offense

  5. Discipline Action Reason Codes • The reasons students may be removed from their regular classrooms can be grouped in three categories • Non Mandatory offenses • Mandatory DAEP offenses • Mandatory JJAEP (expulsion) offenses 4

  6. Non Mandatory Action Reason Codes • Action Reason Code 01 – Permanent removal by teacher from class • Permanent ban of the student by the teacher from their classroom • Behavior must occur in the classroom • Teacher must document repeated behavior and deny right to return to their classroom

  7. Non Mandatory Action Reason Codes • Action Reason Code 10 – Non-Title 5 Penal Code Felony • Occurring off campus while the student is not in attendance at a school-sponsored or school-related activity

  8. Non Mandatory Action Reason Codes Action Reason Code 21 – Any other violation of the Student Code of Conduct that is not specifically listed under another Action Reason Code

  9. Non Mandatory Action Reason Codes • Action Reason Code 22 – Criminal Mischief • Action Reason Code 23 – Emergency Placement • Behavior must be eligible for DAEP placement or expulsion either under state law or local policy

  10. Non Mandatory Action Reason Codes • Action Reason Code 33 – Tobacco offense • Possessed, purchased, used, or accepted a cigarette or tobacco product as defined in the Health and Safety Code • Action Reason Code 34 – School related gang violence

  11. Non Mandatory Action Reason Codes • Action Reason Code 41 – Fighting/Mutual Combat • Must have at least two offenders to use this code • Must not include any behavior more specifically defined (such as assault, aggravated assault, etc.)

Non Mandatory Action Reason Codes • Action Reason Code 49 – Engages in deadly conduct • Action Reason Code 56 – Student is required to register as a sex offender under Chapter 62 of the Code of Criminal Procedure and is not under court supervision • Offense must have occurred on or after September 1, 2007

Non Mandatory Action Reason Codes • Action Reason Code 58 – Breach of computer security by knowingly accessing a computer, computer network, or other computer system without consent. • Computer or system must be owned or operated on behalf of the school district and • Student knowingly alters, damages, or deletes school district property or information • Action Reason Code 59 – Serious misbehavior while expelled or placed in a DAEP

  14. Mandatory DAEP Action Reason Codes • The following behaviors must occur at school or at a school sponsored activity, whether on or off campus • These behaviors require law enforcement verification before categorizing a student with one of these Action Reason Codes (must have police report)

  15. Mandatory DAEP Action Reason Codes • Action Reason Code 02 – Conduct punishable as a Felony • Includes offenses such as vandalism or criminal mischief where damage exceeds $1500

  16. Mandatory DAEP Action Code Reasons • Action Reason Code 04 – Possessed, sold, used, or was under the influence of marijuana or other controlled substance • Action Reason Code 05 – Possessed, sold, used, or was under the influence of an alcoholic beverage • Action Reason Code 06 – Abuse of glue, aerosol paint, or other such chemical

  17. Mandatory DAEP Action Reason Codes • Action Reason Code 07 – Public lewdness or indecent exposure • Action Reason Code 08 – Retaliation against school employee or volunteer • Can be used whether offense occurred on campus or off campus

Mandatory DAEP Action Reason Codes • Action Reason Code 09 – Title 5 Felony occurring off campus and while the student is not in attendance at a school sponsored or school related activity • Action Reason Code 26 – Terroristic Threat • The student making the threat must exhibit/posses the ability to carry out the threat • The recipient of the threat must believe the threat will be carried out

Mandatory DAEP Action Reason Codes • Action Reason Code 27 – Assault against a school district employee or volunteer • There must be a victim and a perpetrator, and the victim must receive bodily injury • Action Reason Code 28 – Assault against someone other than a school district employee or volunteer • There must be a victim and a perpetrator, and the victim must receive bodily injury

  20. Mandatory DAEP Action Reason Codes • Action Reason Code 55 – Student is required to register as a sex offender under Chapter 62 of the Code of Criminal Procedure and is under court supervision • Offense must have occurred on or after September 1, 2007

  21. Mandatory DAEP Action Reason Codes • Action Reason Code 35 – False Alarm or False Report • Examples include pulling the fire alarm, calling in a bomb threat, or giving any other false report that invokes emergency services

  22. Mandatory Expulsion Action Reason Codes • Action Reason Code 11 – Used, exhibited, or possessed a firearm • This does not include BB guns, pellet guns, or air-soft guns • Action Reason Code 12 – Used, exhibited, or possessed an illegal knife • Knife blade must be greater than 5.5 inches

Mandatory Expulsion Action Reason Codes • Action Reason Code 13 – Used, exhibited, or possessed an illegal club • Many common items that are not clubs fall into this category if they are used as a club against someone (like a baseball bat or board) • Action Reason Code 14 – Used, exhibited, or possessed a prohibited weapon

  24. Mandatory Expulsion Action Reason Codes • Action Reason Code 16 – Arson • Action Reason Code 17 – Murder, capital murder, or criminal attempt to commit murder • Action Reason Code 18 – Indecency with a child • Action Reason Code 19 – Aggravated kidnapping

Mandatory Expulsion Action Reason Codes • Action Reason Code 29 – Aggravated assault against a school employee or volunteer • Assault results in serious bodily injury to the victim • Action Reason Code 30 – Aggravated assault against someone other than a school employee or volunteer • Assault results in serious bodily injury to the victim

  26. Mandatory Expulsion Action Reason Codes • Action Reason Code 31 – Sexual assault or aggravated sexual assault against a school employee or volunteer • Action Reason Code 32 – Sexual assault or aggravated sexual assault against someone other than a school employee or volunteer

  27. Mandatory Expulsion Action Reason Codes • Action Reason Code 36 – Felony controlled substance violation • Any amount of cocaine, meth, heroin, 4 or more ounces of marijuana, etc. • Action Reason Code 37 – Felony alcohol violation • Action Reason Code 46 – Aggravated robbery

  28. Mandatory Expulsion Action Reason Codes • Action Reason Code 47 – Manslaughter • Action Reason Code 48 – Criminally negligent homicide

  29. Mandatory Expulsion Action Reason Codes • Action Reason Code 57 – Continuous sexual abuse of young child or children under Penal Code 21.02 • Occurring on school property or while attending a school sponsored or school related activity on or off school property

Discipline Action Codes • Discipline Action Codes are the codes used to describe the consequences given to a student for the offense they committed. • Multiple codes may be used for each offender • For example a student may receive an out-of-school suspension (OSS) as well as a DAEP placement

Discipline Action Codes • Action Code 06 – In-School Suspension • Max number 30 days, 10 days consecutively • Attendance must be taken but teacher, students MAY NOT take attendance • Sign In sheets MAY NOT be used!! • Action Code 05 – Out-of-School Suspension • Can not assign a student to more than three (3) days of OSS • A partial day suspension counts as one of the three allowed

  32. Discipline Action Codes • Action Code 07 – DAEP Placement • Action Code 02 – Expulsion to JJAEP • Requires a formal expulsion hearing

Discipline Action Codes • Action Code 27 – Mandatory disciplinary action not taken as a result of ARD committee manifestation hearing determination, made in accordance with IDEA for a student receiving special education services, that the student’s behavior is linked to the student’s disability

Discipline Action Codes • Action Code 28 – Mandatory DAEP/JJAEP placement not taken because the district considered one or more provisions that allows the district to consider self defense, intent or lack of intent, student’s disciplinary history, or disability that substantially impairs the student’s capacity to appreciate the wrongfulness of the student’s conduct as a factor in a decision to order suspension, removal to a DAEP, or expulsion

  35. Special Education Students • The placement of a student with disabilities in JJAEP, who receives special education services, may be made only by a duly constituted Admission, Review, and Dismissal (ARD) committee • Under federal rules and regulations, special education student must be allowed to continue their education program regardless of what behavior they have committed

Discipline Documentation The documents that are available online are Discipline Code tables • The action reason code table with a list of the codes and brief descriptions • The action code table with a list of the codes and brief descriptions • The difference reason code table (used when actual days do not match scheduled days) Discipline Documentation • Step-by-step instructions for entering a discipline incident into TXEIS • Changing an existing incident in TXEIS • Printing the discipline form Appendix E from the PEIMS Data Standards • Overview of procedures that need to be followed when sending a student to DAEP or JJAEP • Detailed descriptions of all the various action reason and action codes All individuals who handle discipline incidents should be familiar with all of these documents as well as all local procedures regarding discipline

Things to Remember • If a student is given out-of-school suspension any part of a day counts as a full day for state reporting purposes • A student may not be given more than three (3) days of out-of-school suspension for any given discipline incident • If coding a student with fight/mutual combat there must be two offenders entered under one discipline incident

  39. Things to Remember • Remember that if multiple students are involved in an incident there should only be one incident entered…multiple offenders can be coded under a single incident • Do not add extra days to the original action length for behaviors that occurred after the initial incident • For example a student is sent to in-school suspension for disruptive behavior in the classroom. While in ISS the student continues their disruptive behavior and another 2 days of ISS is tagged onto the end of there stay. This should be coded as a separate incident. Do not add the extra 2 days of ISS to the original incident length.

  40. Things to Remember • Your attendance date and discipline MUSTmatch. The state will audit this data to verify that a student in ISS/OSS is marked accordingly in attendance data. • DATES MATTER- If the student’s placement dates change for ANY reason ( more/fewer) this must be indicated on the incident in Discipline. It will be compared to the attendance data.

  41. Things to Remember • Please make sure your incident comments support the action reason code given • For example if you use code 21 (code of conduct violation) make sure the comments don’t say something along the lines of ‘student was caught with marijuana’ • Make sure you enter your discipline data in a timely manner. All incidents should be entered into TXEIS within one full school day of the incident’s occurrence

  43. DAEP Procedures • Remember to enter the discipline incident into TXEIS prior to withdrawing the student and sending them to DAEP • Make sure you have followed the NEW procedures for sending the student to DAEP, this will make the transition easier on everyone

  44. New TXEIS User's • All staff, who have not gone through basic discipline entry training, and will be entering data into TXEIS are required to go through a basic discipline data entry course • Returning users who would like a refresher are also welcome!
