  4. WRDA 2007 Authorization ‘(c) IMPLEMENTATION OF ST. CLAIR RIVER AND LAKE ST. CLAIR MANAGEMENT PLAN.— The Secretary shall— ‘‘(A) developa St. Clair River and Lake St. Clair strategic implementation plan in accordance with the management plan (recommendations); ‘‘(B) provide technical, planning, and engineering assistance to non-Federal interests for developing and implementing activities consistent with the management plan; ‘‘(D) provide, in coordination with the Administrator of the Environmental Protection Agency, financial and technical assistance, including grants, to the State of Michigan (including political subdivisions of the State) and interested nonprofit entities for the Federal share of the cost of planning, design, and implementation of projects to restore ‘‘(e) AUTHORIZATION OF APPROPRIATIONS.—There is authorized to be appropriated to carry out this section $20,000,000.’’

The Road Ahead • American Recovery and Investment Act (“Stimulus”) signed into law in February; • “OMNIBUS” (Consolidated Appropriations Act) contains 9 spending bills (two already approved) • Once Omnibus is signed, Corps-HQ needs to compare Omnibus vs. Stimulus – No “double-dipping”. Once resolved, may announce. • When appropriations are set, “Implementation Guidance” has to be issued by USACE-HQ before proceeding with any work. • Money may not arrive until mid-April at the earliest.

  6. The Road Ahead • Intent is to apply $$$ to “shovel-ready” projects, not those still in planning; • Exception is those that can be constructed in 2009 or 2010; • If additional non-construct work has to be done, must contract out most of $$ for this purpose. • Most other agencies do not have this conflict; mainly programs or general agency funding – Corps has specific projects (“line items”) in spending bills.
