What it is the 4th amendment? • The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

  3. Your rights • Be secure on private property • No unreasonable search and seizure • Warrant needed • Unless probable cause • Different in school

  4. Life when the amendment was created • Late 1700’s • No technology, easy way of life • Life was much more private

  5. Evolution of Amendment • Social networks • Life is broadcasted • Court rules

  6. Court case: New jersey vs. TLO • 14 year old freshman convicted • Smoking in school lavatory • Unwarranted search Supreme court decision: 6 to 3 against TLO

  7. Court Case: bugged telephone • FBI bugged payphone • No warrant Supreme court decision: 7 to 1 against the government

  8. Court case: drug testing for student athletes • Sign up and make commitment • Parents of student refused test • Unconstitutional Supreme court decision: 6 to 3 in favor of drug testing
