  2. Why a Bill of Rights? • Though most states had their own Bill of Rights, the Anti-federalists would not sign the Constitution without one! • They were worried!

  3. The 1st Amendment Freedom of press Freedom of Speech

  4. The 1st Amendment Freedom of Petition Freedom of Religion Freedom of Assembly

  5. The 2nd Amendment The right to bear arms and maintain militia Not all arms!

  6. The 3rd Amendment • Restricts quartering of troops • Not valid during emergencies!

  7. Protects against unreasonable searches and seizures The 4th Amendment The need for probable cause, search warrants, and arrest warrants

  8. The 5th Amendment • Assures the right not to be deprived of “life, liberty, or property, without due process of law” • Includes protection against double jeopardy… • Self incrimination… • Seizure of property w/o compensation

  9. The 6th Amendment • Guarantees the right to a speedy and public trial by an impartial jury

  10. The 7th Amendment Trial by jury, though small claims is a judge

  11. The Eighth Amendment • Protects against excessive bail, • Cruel and unusual punishment ??????????? ??????? ??

  12. Amendment 9 • People’s rights are not restricted to only those in the Constitution! Amendment 10 Restates federalism: powers not listed for the federal governerment belong the states and people!
