Gate Keeping at National and Sub National Level CHILD’S RIGHTS AT THE LOCAL LEVEL The local public administration authorities Municipalities, towns and communes The social assistance public service (SPAS)  Monitors the situation of the children residing on its territory as well as the way their rights are respected  Accomplishes all the necessary activities in order to prevent the separation of the child from his/her family - elaborates service plans according to the specific situations - have the obligation to organize day care services (in order to prevent separation)

Gate Keeping at National and Sub National Level CHILD’S RIGHTS AT THE COUNTY LEVEL General Direction of social assistance and child protection The General Direction of social assistance and child protection(DGASPC) performs a complementary activity to the one carried on by the SPAS: if after granting all the services and allowances foreseen in the service plan, it comes to the conclusion that the child can no longer remain with his/her parents, SPAS will notify the DGASPC, in order to evaluate the case and provide for specialised services, and eventually grant a special protection measure for the child. - residential type services - family type services

Gate Keeping at National and Sub National Level National Authority for the Protection of Child’s Rights (NAPCR) The National Authority for the Protection of Child’s Rights (NAPCR) is organised and functions as a specialized body of the public central administration, providing on the Romanian territory the respect of all the children rights by intervening, according to the law in the administrative and judicial procedures concerning the respect and promotion of children rights.

Gate Keeping at National and Sub National Level National Authority for the Protection of Children Rights (NAPCR) Other central public administration authorities with responsibilities in what the respect and promotion of children rights are concerned, within their activity field, are the following: • The Ministry of Labour, Family and equality of Chances; • The Ministry of Education and Research; • The Ministry of Public Health; • The Ministry of Internal Affairs and Administrative Reform; • The Ministry of External Affairs; • The Ministry of Culture and Cults; • The Ministry of Justice; • The Ombudsman; • The National Council for Combating the Discrimination.

QUALITATIVE EVALUATION – RESPECTING THE QUALITY STANDARDS NAPCR • Inspects the way public or private authorities respects the quality standards. • Issues the functioning license for the services destined to prevent the separation of the child from his/her family, as well as the special protection services destined to the situations when the child is temporarily or definitive missing the protection from the parents. • The functioning license is released based on the complying with all standards corresponding to the services, standards which are elaborated by the NAPCR.

Gate Keeping at National and Sub National Level GATE KEEPING AND MONITORING ACTIVITY • Starting from the children rights as they are mentioned in the CRC, the indicators used by the UNO Committee as well as the problems Romania is confronting today with, we have tried to identify the indicators which were not collected untill now in any of the central institutions. Those indicators lies at the very base of the new instrument of data collection – The MONITORING FICHE • This instrument is transmitted to the DGASPC that, in their turn collect the data at the local level, and after that transmit it to the NAPCR.

Gate Keeping at National and Sub National Level EXAMPLES OF DATA COLLECTION AT THE LOCAL LEVEL • BIRTH REGISTRATION • Children whose birth registration is made after the legal term • Children with both parents registered in the birth certificate, • Children with only one parent registered in the birth certificate • Children with no parent mentioned in the birth certificate • Details provided depending on the moment when the birth declaration was made • SPARE TIME AND CULTURAL ACTIVITIES • Public playgrounds set up by the local town-halls • Private playgrounds

Gate Keeping at National and Sub National Level Child Monitoring and Tracking Information System - CMTIS CMTIS = informatic system for keeping the evidence of the children existing within the child special protection system, coordinated through a server existing at the NAPCR level. Each DGASPC has 4 computers offered by the NAPCR where the data concerning the children within the special protection system is introduced by the users who have received a prior agreement (user name and access password) from the NAPCR. It consists of three modules: • Child –has all the data concerning the active cases found within the evidence of DGASPC – temporarily separated from their parents. • Personal– keeps the information concerning the hired personnel within the child special protection system. • Financial –keeps all the financial data, such as expenses related to the child rights, personnel expenses, utilities, the units themselves, etc. This module is under implementation.
