  2. MontanaCode Annotated • MLIAC is part of the Montana Land Information Act MCA 90-1-401 through 90-1-413; originally passed in 2005. • MLIAC – appointments, terms, vacancies, compensation in 90-1-405

  3. Council memberships • The State Librarian or the State Librarian’s designee who shall: • Serve as the presiding officer of the council; or • Appoint the presiding officer from among the other members of the council; • The Chief Information Officer or the Chief Information Officer’s designee;

  4. Council members appointed by Governor: • The directors of four other departments established in Title 2, chapter 15. A director may designate a person to act in the director’s absence. • Three persons who represent county or municipal government, at least one of whom is active in land information systems; • Two person who are employed by the U.S. department of agriculture; • Two persons who are employed by the U.S,. Department of the interior; • Two persons who are active in land information systems and represent public utilities or private businesses.

  5. Continuance of council members appointed by the Governor • One person who represents Indian tribal interest; • One person who represents the Montana University system; • Two person who are members of a Montana association of GIS professionals; and • One person who represents the interests of a Montana association of registered land surveyors;

  6. Additional Council members: • One member of the Montana state senate, appointed by the committee on committees, who must be appointed prior to the appointment of the member described in subsection (2)e; • One member of the Montana house of representatives, appointed by the speaker of the house of representatives, who may not be a member of the same political part as the member of the senate.

  7. Additional laws • Each council member is appointed for a 2 year term that begins on July 1 of the odd-numbered year and ends on June 30 of the succeeding odd-numbered year. A member may be reappointed to the council. • A vacancy on the council must be filled in the same manner as the original appointment • A member of the council who is not a legislator or an employee of the state or a political subdivision of the state is eligible to be reimbursed and compensated as provided in 2-15-124 • Paid $50 for each day in which the member is actually and necessarily engaged in the performance of board duties and is also entitled to be reimbursed for travel expenses as provided for in 2-18-501 through 2-18-503, incurred while in the performance of board duties • A member of the council who is not a legislator but is an employee of the state or a political subdivision of the state is not entitled to compensation but is entitled to be reimbursed for expenses, as provided in 2-18-501 through 2-18-503. • Meals, lodging and transportation • A legislator who is a member of the council is eligible to be compensated and reimbursed, as provided in 5-2-302. • Mileage in 2-18-503 • Expenses as provided in 2-18-501 and 2-18-502 • Salary equal to ….5-2-301(1)

  8. MLIAC – duties • The council shall advise the department(commission); • with regard to issues relating to the geographic information system and land information; • on the priority of land information, including data layers, to be developed; • On any element of the land information plan described in 90-1-404; • on the development and management of the granting process described in 90-1-404(1)(e); • Management of and distribution of funds in the account; • Assist in identifying, evaluating, and prioritizing requests received from state agencies, local governments, and Indian Tribal government entities to provide development of and maintenance of services relating to the GIS and land information; • Promotion of coordination of programs, policies, technologies, and resources to maximize opportunities, minimize duplication of effort, and facilitate the documentation, distribution, and exchange of land information; and • Advocate for the development of consistent policies, standards, and guidelines for land information Commitments are centered around the annual MLIA land plan and grant review process but could be broadened depending priorities in the strategic vision

  9. MLIAC - operating procedures • Latest revision 09/04/2009 • Review, summary as in statues previous discussed. • Twelve members constitute a quorum for the purpose of conducting business. • Four meetings per year, set dates at first meeting. The council may schedule other meetings at their convenience if needed. • Robert’s rules of order • Agenda at least two weeks proceeding the meeting.

  10. MLIAC – advisory • The Council functions in an advisory capacity, as defined in 2-15-102 • Advisory capacity means furnishing advice, gathering information, making recommendations and performing other activities that may be necessary to comply with federal funding requirements and does not mean administering a program or function or setting policy. • State Library Commission works with at least two other ongoing advisory boards and takes the recommendations of their advisory boards very seriously. They recognize the background work often need to make clear and helpful decisions and they appreciate the role the advisory boards play in helping them to have the essential facts for making the right decisions, they appreciate getting clear and concise recommendations, including optional recommendations if necessary.

  11. Montana State Library Commission (MSLC) • Established in MCA 22-1-101 • State superintendent of public instruction or the superintendent’s designee • Five persons appointed by the Governor, who shall serve staggered term of three years; • A librarian appointed by the Commissioner of higher education from one of the six units of the Montana University system, who shall serve a term of three years. Montana Spatial Data Infrastructure (MSDI) • The Montana Spatial Data Infrastructure (MSDI), which complements the National Spatial Date Infrastructure (NSDI), consists of 15 digital geospatial data themes that have been identified and agreed upon as “necessary to meet the land information needs of the state of Montana and its citizens.” • http://geoinfo.msl.mt.gov/msdi
