  2. Marbury v. Madison • Under President Adams Marbury was appointed as Justice of the Peace in Washington D.C. • Jefferson appointed James Madison as his secretary of state and ordered Madison not to deliver the Marbury commission • Marbury sued Madison to get the appointment he felt he deserved and asked the court to issue a writ of mandamus requiring Madison to deliver the appointment, which was permitted under the judiciary act of 1789. • Marbury’s request for a writ of mandamus was based on a law passed by congress that the court saw as unconstitutional

Judicial Review • Power of the Supreme Court or any court to declare unconstitutional federal or state laws and other acts of government • Created an independent branch of government known as the judiciary • Chief Justice Marshall was responsible for the creation of the judicial branch of government as we know it today

Why did France sell the Louisiana territory? • France needed money to finance their war in Europe • France did not want the U.S. Allying itself with Great Britain • To gain control of the Mississippi • Why was this an issue for France? • Because this would be a distraction for France from their goals of war in Europe

  5. Why did the U.S. want the Louisiana territory • Wanted to expand further west • Jefferson believed that if more people owned land it would be more democratic • Things to remember** • Gain control of the Mississippi for exporting and importing needs

How did Acquiring the Louisiana Territory affect politics in the East • New England tries to secede from the Union • Why did New England want to secede? • They feared that their influence would decline • In Massachusetts a small group of federalist drafted a plan to take New England out of the Union Known as Essex Junto • Who were the Essex Junto? • Group of lawyers and merchants from Essex county, who supported Alexander Hamilton

Burr Conspiracy • In 1804 during a campaign Hamilton called Burr “A dangerous man, and on who ought not be trusted with the reins of government.” • Burr was offended and wanted a duel with Hamilton • Burr was charged with murder in New York and New Jersey • Burr was never convicted because he left to South Carolina and returned later to Washington D.C. To complete his term as Vice President
