3. Statutory Authority for Advisory Committees • Solid Waste Management Act (SWMA) –provides authority to establish two committees • Section 104. Powers and duties of the department. (SWAC) • Section 507. Siting of hazardous waste treatment and disposal facilities. (Hazardous Waste Facilities Planning (HWFP) Advisory Committee)

4. SWMA - Authorization for SWAC - • Section 104. Powers and duties of the department. • (12) appoint such advisory committees as the secretary deems necessary and proper to assist the department in carrying out the provisions of this act.

5. SWMA - Authorization for HWFP Adv. Comm. - • Section 507(b) requires substantially equivalent proportions of the following four (4) groups: • private citizens, • representatives of public interest groups, • public officials, and • citizens or representatives of organizations with substantial economic interest in solid waste management. • Must include, but is not limited to, a rep. of a waste treatment operator, a waste generator, local governments, environmentalists, and academic scientist.

7. - Authorization for RFAC - Section 301. Powers and duties of the department. • (10) Appoint such advisory committees as the secretary deems necessary and proper to assist the department in carrying out the provisions of this act.

8. Authorization for RFAC -(cont.) Section 706. Recycling Fund • Subsection (e): • Composed of representatives of counties, other municipalities, municipal authorities, the municipal waste management industry, the municipal waste recycling industry, the municipal waste generating industry and the general public. • Includes four members of the General Assembly. • Meets at least annually to review the Commonwealth’s progress in meeting the goals under section 102(c), to recommend priorities on expenditures from the fund, and to advise the secretary on associated activities concerning the administration of the fund.

9. Current SWAC Membership • 20-member committee based on Section 507(b) (HWFP requirement) of the SWMA that requires “substantially equivalent proportions of the following four (4) groups: • private citizens, • representatives of public interest groups, • public officials, and • citizens or representatives of organizations with substantial economic interest in solid waste management.”

Goals of Restructuring • Maintain 20-member committee • Continue to have membership composition that provides broad-based knowledge and experience in waste management and recycling issues • Integrate waste and recycling issues • Provide flexibility in filling vacancies without being tied to the HWFP provision of the SWMA

11. Standing Committees • The SWAC Bylaws provide for the establishment of Standing Committees. • The RFAC and HWFP Advisory Committee will be considered Standing Committees of SWAC and will have specific membership according to the authorizing statutes.
