CDM Co-ordinator The Duties • Statutory Basis - Construction (Design & Management) Regulations 2007 - Now includes CHSW regs. and Management regs. - Managing Health and Safety in Construction (ACOP) - ALL are Secondary to Health & Safety at Work Act 1974 • CDM Regulations 2007 imposes responsibilities on - Client - Designers - CDM Co-ordinator - Principal Contractors - Contractors RP&P Management Limited 4

CDM Co-ordinator Application of Duties • ALL the duty holders responsibilities apply if a contract for work - Lasts longer than 28 days • - There are more than 17 men on site • For smaller works CDM still applies but a CDMc does not need to be appointed and it is not notifiable to HSE - Client, Designer, Principal Contractor and Contractor responsibilities • Requirement to appoint a CDM Co-ordinator for Demolition • What is a Designer? - Includes anyone who specifies RP&P Management Limited 5

CDM Co-ordinator Health & Safety Files Changes • Electronic Health & Safety Files - Health & Safety Files to be made available on RPPML Portal - Changes to H & S Files can be carried out by Client’s on line - Portal can be used for Client’s “Asbestos Register” Main Changes to the Regulations (ACOP) -Requirement to appoint a Co-ordinator no later that detail design (stage D) -The Coordinator will manage the flow of Health and Safety information between Client, Designer and Principal Contractor -The Client will appoint the Co-ordinator who will assist the Client with their duties -The Co-ordinator will have a greater involvement in design and construction RP&P Management Limited 6

Party Wall Surveying Statutory Basis • The Party Wall etc Act 1996 The Act governs the way in which a building owner can carry out work to a party wall, party structure or party fence wall • What is a party wall? - A wall is a party wall if it stands astride the boundary of land belonging to two or more different owners - A wall is a party fence wall if it is not part of a building, and stands astride the boundary line between lands of different owners - A party structure could be a wall, floor, partition or other structure separating buildings or part of buildings RP&P Management Limited 14

Party Wall Surveying The Role and Authority of Surveys • Notification to ALL adjoining owners of the proposed work - Maximum of 2 months notice is required depending on the type of notice - Notices must include drawings which indicate precise details of the proposals • Obtaining adequate information from the Design Team - Must be able to show exact proposals to adjoining owner and/or surveyor • Agreeing the Award - Of critical importance is the Schedule of Conditions, even if no award - The award is a legally binding document stating how and what will be done - Case law has emphasised the importance of complying with the Act • Completing the works - Final check after work completed to ensure no damage to adjoining owner RP&P Management Limited 15

Building Surveying Type of Surveys • Commercial Building Surveys - Full or part inspections and reports to identify defects and diagnose cause - Measured land and building surveys for production in AutoCAD format - Dilapidations surveys during or at the end of a lease (CPR) - Condition surveys for property assessments and future budgeting • Pre-Acquisition Surveys - Full inspection and reports on condition of Freehold and Leasehold property - Estimate of likely scale of repairs/improvements in short to long term • Defects Analysis - Investigation into latent defects on building projects - Investigation and reporting on failure of a particular building element RP&P Management Limited 17

Residential Surveying Boundary Disputes • Neighbours at war - Exact boundary lines between properties are difficult to define - Original boundaries can be altered - Non defined boundaries may have been assumed • Defining a boundary - Neighbour may have acquired land through adverse possession - Obtain title deed plan and register (if registered) - Original title deeds (written description over plan) - Accuracy of 1:1250 title deed plan plus or minus 1.0 m (2.3m for 1:2500) - Aerial photographs - Documents from recent property transfer - Existing features on the ground may help together with nearby properties RP&P Management Limited 26

Residential Surveying Expert Witness • Role of the Surveyor - Asked to provide advice on poor workmanship and materials - Kitchens, joinery, brickwork, plumbing, boundaries etc - Minimum of 5 years of experience in the particular field - Written report to be prepared in model format • Duty to the Courts - Governed by part 35 of the Civil Procedure Rules (CPR) - Independent and impartial advice overriding obligation to appointing party - Without prejudice meetings set out what has and has not been agreed - May be required to give evidence in court RP&P Management Limited 27
