  5. Subpart A – General Provisions • Definitions • Some spelled out in CAAA [112(a)] • Can’t find in specific rule – look in Subpart A then to dictionary • Remember, area source = minor source of HAP

  10. 112(j) - Operating • CAAA – schedule to develop standards • “MACT Hammer” • EPA has missed deadline [112(e)] to issue rule for listed source category or rule is VACATED for major source • History & updates** • NDEQ develops source specific MACT • Operating permit

  11. 112(g) & 112(j) • Rule promulgated later that applies • Comply with rule not source specific determination • If source specific determination more stringent – NDEQ can enforce its determination instead of rule

  12. Residual Risk & Technology Review • EPA to review standards every 8 years • Remaining risk [112(f)] • Second phase • New technology available [112(d)] • Some rules change a lot & others have no changes

  13. Once In, Always In • Once compliance date passes • Subject to the rule forever • Major sources • Can take limits to stay out of future rules • Doesn’t apply to most area sources (Title V)
