  3. Background • History The Ranger Drainage District (RDD) was created in 1970 under the provisions of Chapter 298 Florida Statutes to be an independent special district. The District, as government agency, has constructed a series of canals and secondary outfalls that provides stormwater drainage for properties located within the District. There are five major canals and numerous secondary outfalls.  The District covers a total of 15 square miles.

Permit Application • County Authority Chapter 16 – Orange County Excavation & Fill Ordinance • Sec. 16-21 (a) It shall be unlawful to excavate or fill until a permit has been issued. • Sec. 16-23 • Unless otherwise stated herein, the county engineer shall submit his or her recommendation relative to the issuance of a permit under this chapter to the board of county commissioners for official action. • The board of county commissioners may approve the permit application and may include any conditions necessary to ensure compliance with these regulations or may deny the permit. (c) The board of county commissioners may take action during any regular session of the board of county commissioners or may, at its sole discretion, require that a hearing be held on the permit application with notice to abutting property owners.

Staff Analysis • Construction Plans submitted by RDD are found to be acceptable subject to six waivers: • Waiver Request • A waiver from Code Ch. 16-22(a)(2) to relieve RDD from posting a separate surety to guarantee performance of restoration activities; • A waiver from Code Ch. 16-22(a)(4) to allow RDD to proceed without submittal of owners consent; • A waiver from Code Ch. 16-22(a)(5) to allow RDD to utilize the submitted construction plans in lieu of a certified topographic survey;

Staff Analysis • Waiver Request (Cont.) • A waiver from Code Ch. 16-8(a)(3) to relieve RDD from planting trees along the border of the excavation site; • A waiver from Code Ch. 16-8(b)(1) to relieve RDD from providing a 50 foot setback within the agriculture zoned property; and • A waiver from Code Ch. 16-8(b)(3) to relieve RDD from fencing and signage requirements during construction.

Staff Analysis • Waiver of Owners Consent • 5 of 17 parcels have provided consent. • County Code clearly requires owners consent. • Plat delineates easement area as “Outfall Canal” and not as a lake. • Plat dedication does not include easement for perpetual use to public. • Staff does not support waiver of owner’s consent. • Remainder of waiver requests are supported by staff.
