  2. The Background EMPLOYMENT OF CHILDREN IS ENCOMPASSED WITH MORE THAN 200 PIECES OF LEGISLATION Employment • CYPA 1933 & L.A. Byelaws Entertainment • CYPA 1933/63/69 • The Children (Performances) Regulations 1968 (as amended)

  3. Employment • Inconsistent interpretation • Confusing prohibitions • Removal from ‘Model Byelaws’ • LA priority • Resources – Financial & Human

  4. Prohibitions • Commercial kitchen • Butcher’s – ‘meat for sale’ • Cinema’s • Milk rounds Industrial undertakings

  5. Entertainment • Inconsistent interpretation • Confusing legislation • Insufficiently trained staff • Insufficient resources • LA Priority

  6. Better Regulation Task Force (BRTF) • April 2004 BRTF publish their report which identifies ‘a need for change’ • It makes FIVE recommendations

  7. BRTF Report Recommendations: - • DfES to commence work on consolidating child employment law by September 2004 • Move to registration of employer (rather than the child) by February 2005 • Children to work more than two hours on a Sunday by February 2005 • Following consolidation of law, DfES to work closely with LA’s to provide best practice guidance on the law for all users • Director of Children Serviceto child employment as part of their remit.

  8. BRTF Report (continued) • December 2004 informal consultation on ‘Employers’ bodies commences • February 2005 DfES advise they will be calling a further meeting in April 2005 following consultation process so far. • March 2005 ‘General Election’ called

  10. The Way Forward • With the help of our Legal advisor Carolyn Hamilton – Director of The Children’s Legal Centre we have formed a full review of potential law changes

  11. Present Day Employment Current ministerial commitment to provide (non statutory guidance on CURRENT employmentlaw NO COMMITMENT ON LEGISLATIVE CHANGE

  12. Present Day (continued) • NNCEE negotiating with DCSF on guidance and……… • Maintaining it’s commitment to seek legislative change

  13. Present Day – Entertainment Regulations • NNCEE met with DCSF present first draft regulation change document • Further consultation ongoing • Second draft to DCSF end of year/ early January 2009
