  3. 何謂網路隱私權 • 隱私權是20世紀才出現的法律概念，起源於美國。 • 美國法律中視為是一種「不受干擾的權利」。 • 網路空間的個人領域與公共領域 • 個人的私生活有不受公開干擾之權利 • 個人資料應受保護

  5. 法規 • 個資法(電腦處理個人資料保護法) • 1985年訂立 • 目的:規範電腦處理個人資料，避免權利受侵害，並促進個人資料的合理使用 • 通訊保障及監察法 • 2007年訂立 • 目的:為保障人民秘密通訊自由不受非法侵害， 並確保國家安全，維持社會秩序，特制定本法

  6. 蘇柏榕案例 • 國中為了查成績，入侵基測電腦資料庫 • 民國92年，就讀建中，入侵總統府網站宣布愚人節放假一天 • 高中畢業時又入侵大考中心竊取考生資料 • 民國96年，被黑道吸收，入侵中華電信、台大BBS，竊取千萬筆個資和email給補習班和詐騙集團，名模林志玲也是受害者之一
