ExIA & Battery Industry History • Battery Directive to collect & recycle batteries in force since 1991 • Covers only Mercury-, Cadmium- and Lead-containing batteries • Divergent transformation by EU-member states one of the reasons to rewrite the Battery Directive
ExIA & Battery Industry • Working documents appeared from 1997- 2001 • The latest draft did not pass the Commission panels • Existing standard procedures failed
ExIA & Battery Industry Extended Impact Assessment: • The Extended Impact Assessment can be the valid approach • A public consultation with the political options was accomplished ( Feb.25-Apr. 28, 2003) • The Commission selected a consultant to perform the ExIA (Apr.-July) • Stakeholder-meeting in July 2003 • Interservice-Consultation October 2003
ExIA & Battery Industry • So far as it can be seen the procedure of an ExIA has some advantages: 1. Knowledge of the policy options at an early stage 2. Streamlined input of relevant data by stakeholders to the selected consultant 3. Additional exchange of views with Commission representatives
ExIA & Battery Industry But as already said, the rationals found during the ExIA does not refrain the Commission to take other political decisions which are not in line with the findings of the assessment
ExIA & Battery Industry • So at the end, the stakeholders affected by the new Battery Directive have to see, if the Commission follows the lines of the ExIA (assuming the ExIA was properly done) and not going for targets ( i.e. ban of substances, collection & recycling) which are unrealistic
ExIA & Battery Industry The Extended Impact Assessment could be an excellent tool if properly handled and used The Commission proposal for the New Battery Directive will be the touchstone for the Battery Industry
