  4. “Award” Letters Letters regarding funding for the 2010–11 school year is anticipated to be mailed out late November. The letters confer spending authority for the Limited English Proficient (LEP) and Immigrant Education Programs, and local educational agencies (LEAs) do not need to wait to receive their apportionment from their county offices in order to begin spending. In future years, LEAs will not receive a letter regarding their allocation amounts. They may access their allocations around mid-November of each year at the Consolidated Application Program Entitlements Web page at http://www.cde.ca.gov/fg/aa/ca/consolapp.asp.

  5. Allocation Amounts The per-pupil allocation for LEP is $105.75. The total allocation amounts will be available on the Title III Language Instruction for LEP Students Web page at http://www.cde.ca.gov/sp/el/t3/lep.asp in late November. The per-pupil allocation for Immigrant is $105.00. The total allocation amounts will be available on the Title III Immigrant Students Web page at http://www.cde.ca.gov/sp/el/t3/immigrant.asp in late November.

  6. Apportionments The request for the last apportionment for fiscal year (FY) 2008–09 was submitted to the School Fiscal Services Division (SFSD) in mid-October. The third apportionment for FY 2009–10 was submitted to the SFSD in mid-October. The first apportionment for FY 2010–11 is anticipated to be processed by late November.

  7. End of Year Expenditure Reports End of Year (EOY) Expenditure reports were due on November 1, 2010, and the window is now closed. If your LEA has not submitted, please contact the Language Policy and Leadership Office (LPLO) immediately. All obligations must be liquidated no later than 90 days after the funding period ends. For the FY 2008–09 sub-grant, all obligations need to be liquidated by December 30, 2010.

  8. Legal Obligations According to the California State Accounting Manual, “Legal obligations are commitments made by an LEA to purchase goods or services immediately or in a future period.” To determine whether a financial commitment should be reported as an obligation, please refer to Title 34, Part 76, Section 707 from the Code of Federal Regulations (CFR): Retrieve by CFR Citation Web page found at http://www.gpoaccess.gov/cfr/retrieve.html (Outside Source).

  9. The Student National Origin Report LEAs not submitting a Student National Origin Report (SNOR) in FY 2010 will be receiving a “Late SNOR letter” and will need to submit their SNOR immediately. Non-submission of SNOR data can impact eligibility for Title III Immigrant funding for up to three years.

  10. The Student National Origin Report LEAs should have submitted SNOR data via California Longitudinal Pupil Achievement Data Systems (CALPADS) on October 6, 2010, and will update SNOR data via CALPADS on March 1, 2011. Private Schools will submit SNOR data to the CDE electronically via the CDE’s SNOR online reporting Web page. The window will open on March 1, 2011. Note: The Private School immigrant count submitted in March, 2011, should reflect the count taken either on October 6, 2010, or March 1, 2011.   11. Immigrant Student Definition As of July 1, 2009, the definition of Immigrant Students has been updated. Sections 3301(1) and (6) of the Elementary and Secondary Education Act (ESEA) define immigrant children and youth as individuals who: 1) Are aged three through 21 2) Were not born in any state* 3) Have not been attending one or more schools in any one or more states for more than three full (cumulative) academic years. *Section 3301(14) of the ESEA defines “State” as each of the 50 states, the District of Columbia, and the Commonwealth of Puerto Rico.

  12. The Consolidated Application II The Consolidated Application (ConApp) II is due on January 31, 2011. LEAs will report their obligations for FYs 2009–10 and 2010–11.

Two-Way Bilingual Immersion • LEAs will be receiving a letter requesting information for the Two-Way Bilingual Immersion (TWBI) directory. • A form was included with the letter and is to be faxed to Michele Anberg-Espinosa at 916-319-0138 by December 19, 2010, with current information about new or already existing TWBI programs. • Schools currently listed on the directory also should have received a copy of the form and should coordinate with their LEA superintendent’s office so that forms are not submitted twice.

  16. Title III Requires States to: Define two annual measurable achievement objectives (AMAOs) for increasing the development and attainment of English proficiency Include a third AMAO related to meeting Title I Adequate Yearly Progress (AYP) for the English learner (EL) subgroup at the LEA level 18

  19. Title III Requires States to: Continued Hold Title III LEAs and Consortia accountable for meeting all AMAOs Provide technical assistance to LEAs not meeting AMAOs for 2 and 4 consecutive years 19

Consequences of Not Meeting the AMAOs If a Title III LEA or consortia does not meet one or more of the AMAOs in any year, it must: Inform the parents of all ELs in the LEA, or consortia as a whole, that the AMAOs have not been met This notification should be provided within 30 days of the public release of the Title III Accountability Reports 20

  21. Title III Accountability Is at the LEA level only Districts County Offices of Education (COEs) Direct funded charters Consortia Accountability reports are prepared only for LEAs and Consortia that are Title III funded. 21

ELs receiving EL services for 5 years or more • ELs/Consortia must meet targets for both cohorts to meet AMAO 2

AMAO 3 Academic Achievement EL Subgroup must meet AYP targets in: English Language Arts Participation rate Percent Proficient or above Mathematics Participation rate Percent Proficient or above EL subgroup for AYP includes Redesignated Fluent English Proficient (R-FEP) students who have not scored proficient or above on the California Standards Test (CST) in English Language Arts (ELA) 3 times after being reclassified. 24

AMAO 3 Results for 2009–10 • AMAO 3 • 19% of LEAs/Consortia • 7% of LEAs/Consortia in “Pending” • LEAs/Consortia met all requirements for the safe harbor alternative method of meeting the percent proficient criteria for the EL subgroup except the graduation rate requirement received a “Pending” AMAO 3 determination.

Three Major Tasks for the IPA Gather EL student performance data using the English Learner Subgroup Self Assessment (ELSSA) and, with LEA staff, analyze the data and the level of implementation of the current programs and services for ELs 2. Analyze the data and information to discern strengths and weaknesses of the current LEA plan for effectiveness with EL students 3. Formulate responses to address each element of the IPA that needs improvement 33

Consequences of Not Meeting the AMAOs If the LEA or consortia does not meet the AMAOs for four consecutive years (2006ᅳ07,2007ᅳ08, 2008ᅳ09, 2009ᅳ10): • The state shall require the LEA or consortia to modify its curriculum, program, and method of instruction as approved by the State Board of Education in January 9, 2008
