  2. Criminal Attempt: 901 • Substantial step • Renunciation and abandon-ment of crime

  3. Criminal Solicitation: 902 • Intent to promote a crime • Renuncia-tion

  4. Criminal Conspiracy: 903 • Two or more agree to commit a crime

  5. 905. Grading: criminal attempt, solicitation & conspiracy • Penalty the same as committing crime except: murder and Felony 1’s are Felony 2s; mitigation: dismiss if unlikely

  6. 905. Grading Mitigation: if solicitation, attempt or conspiracy unlikely to occur charges my be withdrawn

  7. Multiple Convictions: 906 Can be charged with all three but convicted of only one

  8. Instruments of Crime: 907 • Possession with intent to employ criminally:M - 1

  9. 907 (con’t) • Possession of concealed weapon: M - 1 • Possession of body armor: F - 3 • Instrument of crime - anything adapted for or used for criminal purposes

  10. 907 (con’t) • Weapon - instrument capable of LETHAL use • Body armor - synthetic, protective material to deflect knives or bullets

  11. Prohibited Offense Weapons: 908 • Makes, repairs, sells, deals or possesses offensive weapons • Specific weapons capable ofserious bodily injury • M - 1

  12. 908.1: Use or possession of electric or electronic incapacitation device • DEF: portable device capable of immobiliz-ing a person with electrical current or impulse • Offense defined: us-ing aforementioned item for unlawfulpurpose: F-2; possession: M-1

  13. Possession of Weapon on School Property: 912 • Weapon capable of producing SERIOUS BODILY INJURY • Schools ( public or private) • Grounds • Buses

  14. 912 (con’t) Defense: used for lawful purpose in school

  15. Possession of Firearm or weapon in Court: 913 • Knowinglypossesses: M - 3 • Knowingly possesses with intent to use: M-1

  16. 913 – Possession of firearm or other dangerous weapon in court • Each court house must provide: • 1. A weapons locker • 2. Free of charge • 3. Temporary checking of weapon • 4. Must be cleared by chapter 61 • 5. Must be issued a receipt when checking • 6. Weapon returned upon exit from court
