  2. 720 ILCS 5/19-1 Burglary • A person commits burglary when without authority he knowingly enters or without authority remains within a building, house trailer, watercraft, aircraft, motor vehicle, railroad car, or any part thereof, with intent to commit therein a felony or theft. • Sentence – Burglary is a Class 2 felony. A burglary committed in a school or place of worship is a Class 1 felony. Question: If two officers have to enter a building to check out a burglary how should they enter? Question: Is burglary a property crime or a crime against persons? Question: A lookout for a burglary could pose as what?

  3. 720 ILCS 5/19-3 Residential Burglary • A person commits residential burglary who knowingly and without authority enters or knowingly and without authority remains within the dwelling place of another, or any part thereof, with the intent to commit therein a felony or theft. • Sentence – Residential burglary is a Class 1 felony Question: If I have an attached garage to my residence and I leave my garage door open and a subject enters and steals my lawnmower, did this person commit the offense of residential burglary?

  4. 720 ILCS 5/19-2Possession of Burglary Tools • A person commits the offense of possession of burglary tools when he possesses any key, tool, instrument device, or any explosive, suitable for use in breaking into a building, house trailer, watercraft, aircraft, motor vehicle, railroad car, or any depository designed for the safe keeping of property, or any part thereof, with the intent to enter any such place and with intent to commit therein a felony or theft. • Sentence – Possession of burglary tools in violation of this section is a Class 4 Felony. Question: What is the most common burglary tool?

Classes – X, 1, 2, 3, and 4 Question: Can you give an example of a felony offense? Forcible Felony means treason, first degree murder, second degree murder, predatory criminal sexual assault of a child, aggravated criminal sexual assault, criminal sexual assault, robbery, burglary, residential burglary, aggravated arson, arson, aggravated kidnapping, kidnapping, aggravated battery, resulting in great bodily harm or permanent disability or disfigurement and any other felony which involves the use or threat of physical force or violence against any individual.
