  2. Background On July 6, 2013, a freight train carrying crude oil derailed in Lac-Megantic, Quebec Canada. The derailment resulted in 47 deaths and significant property damage in excess of $200 million dollars. In response to the Lac-Megantic accident and other events, the FRA on August 02, 2013, issued Emergency Order 28 which requires railroads to take six actions related to the securement of certain unattended equipment and relevant accident and inspection data. EO 28 became effective on September 1, 2013.

San Diego Subdivision Freight Operations • In addition to passenger operations, the San Diego Subdivision also supports freight operations by BNSF and PACSUN. • BNSF and PACSUN operations support the movement of the following types of commodities including: • ABC • BNSF’s transport of hazardous materials is regulated by ____ • The Shared Use Agreement between BNSF, MTS, and NCTD (does what in terms of liability for haz mat)

  4. The impact of EO-28 for NCTD Generally, EO-28 does not apply to Passenger Rail vehicles or operations. However, NCTD serves is the owner of the railroad and is responsible for ensuring that our freight operators have a plan that meets the requirements of EO 28 are met.

What is Emergency Order 28? • The order established (6) Requirements • No Train transporting hazardous materials may be left unattended on mainline or mainline siding until the railroad develops or adopts a plan. • Railroads are required to develop a process for securing unattended equipment on a mainline track or mainline siding.

  6. What is Emergency Order 28? Railroads are required to review and verify, adjust as necessary, existing procedures and processes related to the number of handbrakes to be set on unattended trains and equipment to ensure the means of verifying that number is appropriate. Railroads are required to implement operating rules and practices requiring the discussion of securement for any job that will impact or require securement of any train in the course of work being performed.

  7. What is Emergency Order 28? • Railroads are required to develop procedures to ensure that qualified railroad employees inspect all equipment that any emergency responder has been on for proper securement before the train is left unattended. • Railroads are required provide notice of EO-28 to all employees affected.

  8. Next Steps NCTD has created a plan to address EO-28 that adopts the plans of BNSF and PSRR and includes the following provisions: TASI provides BNSF System Special Instruction 37 Key Train Commodity Securement. TASI updates Air Brake and Train Handling Rules (ABTH) TASI/NCTD update General Code of Operating Rules 1.22 (GCOR) Note: NCTD operates under the BNSF GCOR. Herzog Transit Systems Inc. (HTSI) will notify NCTD in the event an EO-28 Train exists in NCTD territory. This will allow NCTD oversight to determine compliance with EO-28 by the freight carriers involved.
