Kazakhstan Status on Negotiations • The Agenda on CC8 included the Item on Kazakhstan’s proposal on amendment of Annex B of Kyoto Protocol for the first session period; • Practically Kazakhstan has acquired the key to enter Annex B of Kyoto Protocol for the second session period; • In the frame of the Convention Kazakhstan has requested commitments on 15% reduction of greenhouse gases emissions until 2020 from baseline of 1990.

THE LAW ON “MAKING AMENDMENTS TO SOME LEGISLATIVE ACTS ON ECOLOGICAL ISSUES” DATED 3 DECEMBER 2011 • Chapter 9-1: State regulation in the field of greenhouse gases emissions and absorptions; • Chapter 20-1: State greenhouse gases emissions and absorptions evaluation system ; • Chapter 45: State regulation of the activity in the field of greenhouse gases emissions and ozone depleting substances .

State regulation in the field of greenhouse gases emissions This Chapter includes 12 Articles and determines: 1) Distribution of quotes for greenhouse gases emissions to nature users; 2) Issuance of certificates for greenhouse gases emissions; 3) Changing of quotes for greenhouse gases emissions and reissuance of certificate for greenhouse gases emissions; 4) National Plan on greenhouse gases emissions quotes distribution; 5) Nature users administering sites; 6) Market mechanism on greenhouse gases emissions and absorptions reduction; 7) Independent information provider; 8) Internal projects on greenhouse gases emissions reduction; 9) Monitoring procedures; 10) Ecological (green) investments;

State greenhouse gases emissions and absorptions evaluation system This 20-1 Chapter includes the following articles: • State greenhouse gases emissions and absorptions stocktaking system; • State cadastre on sources of greenhouse gases emissions and absorptions; • State register on carbonic units; • Verification and validation (determination), confirmation of report on greenhouse gases stocktaking.

  7. State regulation of activity in the field of greenhouse gases emissions and ozone depleting substances This Chapter 45 consists of 10 Articles, of them Article 314-1 “Requirements for installation” comes under quoting system. Installation operators exceeding 20 thousand tons of CO2 greenhouse gases emissions, have to submit an annual report on greenhouse gases stocktaking confirmed by independent accredited organization.

  8. Basis for quotes units issuing in Kazakhstan

National Quotes Allocation Plan The Ministry of Emergency Protection has issued the Order on formation of National Quotes Allocation Plan on greenhouse gases emissions (representatives of the Ministry of Industry and New Technologies of Kazakhstan, Associations, enterprises, independent experts). 5 meetings have been conducted. Sub-groups have been established: Technical and Economical; NQAP is developed in compliance to international voluntary commitments of the country on greenhouse gases emissions reduction to 15% by 2020 from the baseline 1990; NQAP covers the period of 2013-2020: Stage 1 (pilot) – 2013; Stage 2 – 2014-2020.

The First NQAP for 2013 • Allocation of quotes based on CO2 emissions data for 2010; • Covers enterprises emitting over 20.000 tons of CO2 per year; - 177 enterprises; • 145 606 072,13 tons of CO2 – 77% of national CO2 emissions in 2010; • Covers the sectors of energy and industry, oil/coal/gas production

Liability of enterprises for non-fulfillment The European scheme on emissions trading envisages liability of enterprises for non-fulfillment of various requirements related to observance of the specified levels of greenhouse gases emissions, submission of timely and reliable reporting on them; In case of the European scheme, the fine at 100 Euro is paid for quote exceeding per each ton of exceeded greenhouse gases emissions. Besides, non-submission of reporting and other breakages result in suspension or abandonment of the quote for greenhouse gases emission. In case of Kazakhstan, as per the Law the fine at 10 monthly calculation index or around USD 100 has been determined.
