The E2 treaty investor visa grants permission to the visa holder to direct and develop their business or company in the United States. The company name or the business name even gets printed on the E2 visa. However, if you do have any doubts about whether or not you require another work permit (sometimes also known as EAD or Employment Authorization Document) provided by the United States Citizenship and Immigration Services or USCIS, then you are in the right place. To put it in a word, no. E2 visa holders do not need an EAD card or work permit. Let us learn more about the EAD card and help clear your doubt about the E2 visa and the associated work permit. An E2 visa petitioner does NOT require another EAD card or Work Permit. For an E2 treaty investor visa holder, this visa would allow them to work for their own business or company. When the foreign individual receives the E2 visa, the company name or the name of the business gets printed on the E2 visa. The individual can only work in this business with their E2 visa. They do not have any other authorization for working within the US. The good news is that, since you don’t need to face any questions about your employer or who has employed you, you don’t need any other work permit. The spouse of an E2 visa holder requires a different Work Permit or EAD Card. Yes, your spouse needs a separate EAD card or work permit to work in the US. Spouses are given the E2 dependent visa, while the applicant is awarded the E2 investor visa. Hence, the spouse is on a dependent visa, and this visa doesn’t entitle them to find employment in the US. Once your spouse receives the EAD card, they would be entitled to work anywhere within the US, including starting their new business or working in your business in the USA. Detailed below are the steps by way of which an E2 visa holder can get an EAD card for their spouse. ● The spouse should appear for the interview along with the E2 visa petitioner. If both the applicant and the dependent visas get approved, both the passports will then be taken to the US embassy or the consulate. The E2 visas would be printed as well as affixed to their respective passports. After approximately five business days, the passports are mailed to the applicant and their spouse. ● When you enter the US, show your E2 visa at the ‘borders’ (which is usually the airport). ● The E2 visa holder can start working immediately. The spouse, however, has to fill the Form I-765 and mail the form to USCIS. ● Now, the spouse has to wait for the approval process to complete. Generally, it takes approximately 8 to 12 weeks. However, now it takes about 12 to 16 weeks or maybe even longer. The spouse cannot seek employment opportunities unless they have the EAD card or the work permit from USCIS. Different parties may produce a different argument, but it is always better to wait until you receive the official work authorization before finding employment. Dependent children of an E2 visa holder cannot work. The E2 visa holder’s children are not eligible to seek employment, irrespective of their age. The children can attend school. However, they are not permitted to seek work. Therefore, children of an E2 visa holder are not required to petition for a different work permit or EAD card. Finally, the E2 visa holder essentially can only work for the growth and development of their own business. Their spouse, however, can work in the US, but they need to seek permission to work within the US. And, children, irrespective of their age, cannot seek employment in the US.
