  1. Transmitted by the experts of Japan Document No.IWVTA-SGR0-03-03 Consideration of flexible IWVTA scheme Flexible IWVTA scheme No.1 proposed byOICA (image) Stringency of Regulations for IWVTA R0 (the latest version) Universal IWVTA (Used by many countries) Deviation(2) Limited Recognition Deviation(1) Deviation(3) Limited Recognition Limited Recognition Deviation(4) Limited Recognition Number of Regulations -Each CP can arbitrarily use IWVTA of limited recognition with deviations (less items or less stringent Regulations). -Each CP using IWVTA of limited recognition should notify its deviation from the universal IWVTA to UN Secretariat. -Each CP, including those that accept IWVTA of limited recognition, will accept the latest version of RO (universal IWVTA).

  2. Flexible IWVTA scheme No.1 proposed byOICA (image) Deviation(3) (Limited Recognition) Universal IWVTA (latest Regulations) Deviation(1) (Limited Recognition) Deviation(2) (Limited Recognition) -Universal IWVTA will be accepted by all countries. -We need to consider how to stipulate provisions regarding acceptance of type approvals based on required UN Regulations including deviations. For example, will Deviation (2) be legally accepted by countries applying Deviation (1)?

  3. Flexible IWVTA scheme No. 2 according to the proposal of UNECE TD (image) Stringency of Regulations for IWVTA Universal IWVTA of Series 02 R0 (Series 02 = the latest version) Series01 upgraded + additional Regulation(s) + - For the purpose of the universal IWVTA, the series of Regs. A to E are the latest versions for which the TP period expired. - Under the principle of mutual recognition under the 58 Agreement, all IWVTA (partial and universal) are recognized by all CP applying R0. - For registration purposes, each CP may request, in addition to the partial IWVTA, further technical requirements. - A CP applying R0 may grant IWVTA according to each of its Series. Partial IWVTA of Limited Recognition (Series 01) R0 (Series 01) Series00 upgraded + additional Regulation(s) + Partial IWVTA of LimitedRecognition (Series 00) R0 (Series 00) Number of Regulations - Each CP applying a series of R0 shall notify to UN Secretariat its level of application, if different from the latest series of R0 (Universal IWVTA). - Each CP applying a series of R0 shall recognize the (universal) IWVTA. - Upgrades of a specific series of R0 can be made by Supplements to that series (t.b.discussed). - For national registration purposes of vehicles covered by an IWVTA of limited recognition, each CP may request additional requirements not covered by the partial IWVTA (upgraded or additional Regulations, t.b.d.). 3

  4. Flexible IWVTA scheme No. 2 according to the proposal of UNECE TD (image) Universal IWVTA of Series 02 (Latest Regulations, TP exp.) Parial IWVTA of Series00 Partial IWVTA of Series01 -The universal IWVTA (R0-02) have to be accepted by all CP applying R0. For registration proposes of vehicles, those CP shall not request higher level of stringency. - IWVTA granted according to Series 01 shall be accepted by CP applying Series 01 and Series 00. However, they may request, for the purpose of national registration, additional requirements (not covered by the 01 Series). 4

  5. Comparison of two proposals for flexible IWVTA scheme 5

  6. Note: (*1)The current UN R0 proposed by OICA include both Section 1:“List of mandatory requirements” (Universal IWVTA) and Section 3 “List of alternative requirements for a IWVTA with limited recognition” of Annex 4 in one series of UN R0 (e.g. UN R0-01 Series). Therefore, legally speaking, it is difficult to differentiate the universal IWVTA from that of limited recognition under the current 1958 Agreement in terms of acceptance of those IWVTAs because both IWVTAs belong to UN R0-01 Series. Thus, some special treatment may need to be stipulated in order to allow the CP to refuse the IWVTA of limited recognition. ( *2) The series of each individual Regulation in R0-00, for example shall be equal to or earlier than the series of that Regulation in R0-01. This puts some limitation in flexibility regarding the application of Regulations. Example Series00 of R0 Series01 of R0 If series 01 of R0 contains series 02 of Regulation A, the supplement of series 00 of R0 can upgrade the series of Regulation A up to series 02 but cannot contain series 03 of Regulation A. This is because a CP applying the series 00 of R0 should accept the IWVTA issued based on series 01 of R0 which includes series 02 of Regulation A.
