Health Professions Regulatory Reform Initiative Project Overview

This project aims to develop a Health Professions Statute and Reserved Action Regulation to reform the regulatory system. It involves collaboration with regulatory bodies, government teams, and legal counsel. A comprehensive report comparing international and Canadian jurisdiction experiences will inform policy development. The project also includes reviewing existing legislation, developing a White Paper with government proposals, and conducting stakeholder consultations. The implementation is scheduled to commence in Fall 2008.

  2. Project Goals • Development of Health Professions Statute is the first priority - Spring, 2008 target date for introduction • Development of Reserved Action Regulation by Fall, 2008 • Implementation to commence Fall, 2008

Team/Resources • Health Profession Regulatory Bodies • Government Team • Legislative Unit Staff • Legislative Counsel Staff • Health Workforce Staff • Legal Counsel (as required) • Contract with Fiona McDonald, Researcher, Dalhousie Health Law Institute to prepare a report comparing and contrasting key reform elements in B.C., AB., ON, United Kingdom (England), New Zealand and Australia (Victoria) – Want to draw on the experience of other countries, as well as Canadian jurisdictions, in the development of policies.

  4. Contract for review of legislation in other jurisdictions re: key reform elements has been initiated and is to be completed by mid-December, 2006. Departmental review of previous reports and consultations – to identify issues to be addressed in HPRRI – preliminary work has commenced.. Preliminary work initiated on web site development. Review of provisions to be carried forward in new legislation.First Step - Complaints and Discipline Model – It is not our intention to make major reforms to the current model. However, we request the professions’ views as to whether there are improvements which could be incorporated within the existing model. (It is suggested that the provisions in The Dental Hygienists Act be reviewed. This Act can be accessed at the following site: http://web2.gov.mb.ca/laws/statutes/2005/c05105e.php ) Preparation of a White Paper to provide Government proposals to address key reform elements identified in Minister’s Sale’s February/06 correspondence – Target Date – June 30/07. Schedule – Phase 1 Statute Development

Schedule – Phase 1 (continued) • Consultation on White Paper – to be completed by October 31, 2007 • Legal Drafting to commence – Fall, 2007 • Consultation with broad range of stakeholders on draft bill – February, 2008 • Introduction of Health Profession Bill – Spring/08 • Development of Repeal and Replacement Plan – Summer, 2008 • Staged Proclamation of Health Professions Act to commence – Fall, 2008

  6. Schedule – Phase 2 Reserved Action Regulation • Regulatory bodies to review listing of controlled/reserved actions/restricted activities in Ontario, British Columbia and Alberta • Regulatory bodies to review assignment of these activities by jurisdictions on a profession by profession basis • Regulatory bodies to develop a proposed list of reserved actions for Manitoba including consistent interpretation for each action. • Government review of proposed list, followed by final consultation on proposed list with all stakeholders to determine final listing. • Target date for enactment of reserved action regulation would be Fall, 2008.
