  2. What is the Ohio Lakefront Group • Non-Profit and non-partisan • Incorporated in 1999 • Grassroots volunteer organization • Ordinary citizens; shoreline residents • At present there are over 7,000 members • There are 15,000 parcels along Lake Erie in Ohio www.ohiolakefrontgroup.com

  3. Purpose • Prevent taking of shoreline property by the State of Ohio • Protect the use of Lake Erie and the environment through reasonable regulation www.ohiolakefrontgroup.com

  7. 10 Years • May 2004—Suit filed • Feb. 2006—From Federal Court to State Court • Dec. 2007—Judge Lucci rules in our favor • Aug. 2009—Appeals Court agrees with Lucci • Sept. 2011—Supreme Court unanimous • Sept. 2012—Lucci defines property rights • April 2014—Appeals Court agrees with Lucci • May 2014—ODNR once again appeals www.ohiolakefrontgroup.com

  8. Lucci’s Second Decision • Defined the Natural Shoreline • Voided Land Leases • Notice to be provided to Governments • Return of Lease Fees • Same Class Certification • Prevailing Party • Attorney Fees later www.ohiolakefrontgroup.com

Lucci’s Second Decision Appealed • The State appealed all aspects of Lucci’s Second Decision. • Appeals Court only addressed the Class Certification issue. • Appeals Court ruled that Lucci was correct and that the same “class” would be used for the penalty phase of this case.   10. State Appeals to the Supreme Court • The S. C. may or may not take the case. • If the S. C. takes the case, it will take over a year from now to get a decision on the “Class” issue. • Then, back to Judge Lucci. www.ohiolakefrontgroup.com

  11. Where is ODNR and A.G. Mike DeWine • Mike DeWine has dropped out. • Special Counsel has been hired for ODNR: • Much more expensive • Higher quality opposition • ODNR is our sole problem (at least for now) www.ohiolakefrontgroup.com

What Are Our Claims (Public Statement Nov. 14, 2011) • Attorney Fees • Deeds have been altered and need to be corrected • People have paid for leases and fees on land that they own • People need to be compensated for the land that was temporally taken by the State for the past 10-20 years www.ohiolakefrontgroup.com
