    2. Results for France Regulations have to be developed, but few changes are needed on the NPPs for harmonization Over two third of the “reference levels” are not formally required according to the study’s definition Very few “reference levels” have to be addressed for implementation The result of the benchmark is not a surprise French situation : one operator of NPPs, State-owned ASN’s requirements have been mostly expressed in individual letters to the licensees The licensees have also implemented safety provisions on their own

Examples of points to be addressed regarding implementation Issue E – Safety Verification Provide means for the control of combustible gases In 2001, ASN decided that all NPPs shall be equipped with passive autocatalytic hydrogen recombiners by the end of 2007 Implementation in progress Issue O – Probabilistic Safety Assessments PSA shall cover all hazards such as fire or earthquake There are level 1 PSA for all French plants, but they do not deal with all hazards ; development of “Fire PSA” in progress It was considered that the results of PSA for external hazards contain too much uncertainties to be used in the safety demonstration Need to discuss how to take into account this reference level

Comments on the results regarding regulation Two issues are relatively well covered by specific French regulations O – PSA (basic safety rule for level 1 PSA) S – Internal fires (ministerial order) On the other topics Parts of existing French regulations have been judged equivalent to some “reference levels” Nevertheless, ASN intends to write new regulatory documents to cover all the “reference levels” in a consistent way

Actions towards harmonization (1) The work has already begun New structure for the regulation Ministerial orders (legally binding) : safety objectives Guides (not legally binding) : recommended means 5 new orders and guides to be drafted, modification of the existing regulation on fire Safety management, quality (all nuclear installations) Emergency preparedness (all nuclear installations) Safety approach for nuclear power plants Design of PWRs Operation of PWRs

    6. Actions towards harmonization (2) Consultation of the stakeholders on the draft documents, including WENRA Discussions needed with French stakeholders to see how to achieve implementation of the “reference levels” that are still not implemented
