  4. Decision-making criteria The proposal must be: • Consistent with the Environment Protection Act • Consistent with State environment protection policies • represents best practice • meets applicable health and environmental objectives

  5. Process – next steps • Assessment period includes - referral replies - expert advice • EPA decision expected before statutory deadline (2 January 2011) • Public notification of decision • Right of appeal to VCAT: 21 days after EPA decision

  11. Best practice definition "the best combination of eco-efficient techniques, methods, processes or technology used in an industry sector or activity that demonstrably minimises the environmental impact of a generator of emissions in that industry sector or activity"

Best practice and project alternatives • Policies require operators “to apply best practice to the management of [their facility’s] emissions”. • “Best practice” focuses on the technical elements of each proposal rather than the broader alternatives to the proposal itself. • In this context, the proposal is for the production of electricity using brown coal (with some natural gas), using new technology not based on conventional brown coal technologies.
