Tax evasion The issues of tax evasion and bank secrecy have recently assumed a higher degree of prominence within the international community, with the G20 calling for action to be taken against tax havens and finance ministers singling out for criticism jurisdictions which they consider deliberately facilitate the evasion of tax. The Hong Kong Government announced in the Financial Secretary's budget speech in February that it will be introducing legislative proposals this year to align its arrangements for the exchange of tax information with current international standards. This will, in turn, enable Hong Kong to extend its network of agreements for avoidance of double-taxation. This is regarded as important in maintaining Hong Kong's status as an international financial centre. It is also important that AIs act prudently in the conduct of their customer relationships and do not, knowingly or deliberately, aid and abet (or wittingly turn a blind eye to) unlawful tax evasion by their customers. Further, it goes without saying that AIs should not market themselves or schemes operated by them as being available for this purpose or incentivise their staff (whether through payments of bonuses or otherwise) to engage in such conduct. The use of illegal means to reduce tax liabilities, including deliberate concealment of assets from taxation authorities, may be expected to increase in the face of the economic downturn. AIs should therefore be vigilant, and should have or put in place appropriate systems of control, to ensure that their staff (i) are fully aware that facilitation of tax evasion, whether by persons resident in Hong Kong or overseas, is not condoned; (ii) maintain the highest standards of integrity in dealing with their customers and clients; and (iii) do not engage in questionable conduct designed to assist unlawful evasion of tax. The HKMA will consider seriously the implications of any involvement in illegal tax evasion in the context of assessing.

Swiss bank UBS�s German subsidiary is under investigation by local prosecutors for purportedly abetting tax fraud. Bank employers allegedly helped investors to hide money pass revenue departments� authorities by transferring it to Switzerland, says Peter Lintz. Reported the investigation on November 8, 2012, Stuttgarter Nachrichten said illegal fund transfers reached well into 2012, money was being moved invisibly via an internal clearing account at UBS�s German branch into Switzerland. Electronic data and other hundreds of thousands materials that were confiscated in UBS�s Frankfurt offices that were raided in May are currently being analyzed by Mannheim prosecutors. The legal inquiries were intended for unknown representatives of UBS�s German division. Some of the bank�s customers are also among targets, added Lintz. As a result Swiss banks have been subject to investigations into tax evasion in the United States and Europe, throwing Swiss banking secrecy, enshrined in the republic�s laws and traditions, into jeopardy. Bank refuses to comment about the issue rather late Wednesday of the same year they emailed a statement trough a spokeswoman stating that the bank is already �cooperating with authorities� but denies to comment on ongoing legal procedures. A number of French offices of UBS were searched as part of a probe into alleged aiding of tax evasion earlier this year. In some other issues involving UBS, they deny media reports telling wealthy Germans to move funds to Singapore and other money centers ahead of a Swiss tax deal due to come into force in January. Since 2009, UBS has closely examined �framework conditions� for business with over 60 countries including Germany and taken steps to adjust or improve the rules wherever necessary, the spokeswoman said.

U.S. Attorney Booth Goodwin announced that Arville W. Sargent, 52, of Chapmanville; Jerome Eddie Russell, 50, of Williamson; Frelin Workman, 58, of Belfry, Ky.; Randy Workman, 36, of Belfry, Ky.; and Arthur J. White, Jr., 60, of Lenore; pleaded guilty this week, Tuesday, Wednesday and Thursday, to frauding BrickStreet Mutual Insurance Company. Sargent, previously employed by Brickstreet, pleaded guilty to honest services mail fraud and tax evasion. Sargent admitted that, from its inception in January 2006 until at least Feb. 1, 2011, he led a scheme to defraud BrickStreet by allowing certain policyholders operating in the coal mining industry to drastically underreport their payroll during annual field audits he conducted on behalf of BrickStreet for the intended purpose of confirming those policyholders were paying accurate workers� compensation insurance premiums. Sargent further admitted that he purposely allowed four �employee leasing� companies, Aracoma Contracting, LCC., Christian Contracting, Newhall Contracting and T&W Services, LLC., all of whom provided labor on a contract basis to coal companies in southern West Virginia, to falsify documents drastically understating their actual payroll.
