Background • Common sets of rules have been implemented : • In CWE since 2009 • In CSE since 2008 • CASC has taken in charge CWE long-term product auctions since 2008 (for 2009 LT capacity rights) • CSE long-term and day-ahead products have been offered through CASC since April 2011 • Two sets of auction rules managed by the same allocation platform: a need for harmonisation

Regulatory guidance: a wish-list • Joint CSE, CWE and Swiss RCC meeting on February, 8th 2011 • Consensus on a wish list sent to TSOs on March, 30th 2011 • Joint CSE, CWE and Swiss IG meeting on July, 1st 2011 • Start of the public consultation on Harmonised Auction Rules on September, 13th 2011

Main points of the wish-list (1/2) • Administrative arrangements • Harmonisation of deadlines, information, terms… • Curtailments • Before nomination • In case of Force Majeure (FM): Reimbursement • Not FM: Compensation scheme in line with FG CACM where applicable • After nomination • Nominated capacity is physically or financially firm except in case of FM • Curtailment of non-nominated held capacity • To be addressed in the HAR

Main points of the wish-list (2/2) • References to specific national requirements and trading rules • Objective to have a stand alone document • Transparency and secondary market enhancement • List of long-term capacity holders • Nomination rules • Create two separate documents: one for auction rules and one for nomination procedures • Further requirements • Harmonisation of concepts such as ‘immediate suspension”, “bid submitter”… • Further clarification in stakeholders’ responsibility
