On 30 June 2017, the Employees’ Provident Fund Organisation (EPFO) issued a circular revising the application form for Certificate of Coverage for employees going to work in a country with which India has a Social Security Agreement. The main changes in the revised format for the Certificate of Coverage application form are as under: 1.Deletion of the following declaration to be provided by the Indian employer and the employee: “We maintain a direct master and servant relationship and that there is no agreement of employment of limited or unlimited duration (implied, oral or written) between the employee and receiving company.“ 2.Requirement to provide details of the employer in the host country The latest circular provides clarity where earlier there was ambiguity on whether or not Certificate of Coverage was available in case of a dual employment / secondment to the host country.

  2. •In addition to the above, the following declarations mentioned in the earlier format for the Certificate of Coverage application form have been removed: Background •Under an applicable Social Security Agreement, an employer may obtain Certificate of Coverage for its employee who is on assignment between India and the host country so that the employee remains covered under the home country social security legislation and claims exemption from the host country social security legislation. •“We are aware that the employee has to produce this certificate of coverage in original as and when demanded by the host country employer/authority, in order to get the exemption status during the posting period in host country.” •“We maintain a direct master and servant relationship and that there is no agreement of employment of limited or unlimited duration (implied, oral or written) between the employee and receiving company.“ •For example, an Indian employee sent by an Indian employer to a country with which India has a Social Security Agreement with Certificate of Coverage will be exempt from host country’s social security contributions, provided he / she continues to make contributions towards Indian Provident Fund. •“That the applicant has worked/not worked* in a foreign country with which India has entered into a social security agreement and he/she eligible/not eligible* to avail the benefits under a social security programme of that country, by virtue of the eligibility gained, under the said agreement. •Social Security Agreements specify the period for which a Certificate of Coverage may be obtained such as 60 months, 48 months, 24 months, etc. This period may be extended upon agreement between the competent authorities of the two countries. *Please strike of which is not applicable” •The revised Certificate of Coverage application form has the following amended declaration: •“The employer shall continue to contribute in respect of this employee in India during the period of posting abroad; during which time the employer- employee relationship shall be maintained. The employer shall inform EPFO about any change in the employment status / secondment of the posted employee during the currency of this certificate. The employee shall inform EPFO, about any loss / theft of this Certificate. The employee and employer shall be jointly and separately responsible for the misuse of any kind, of the Certificate of Coverage, if any.” •Currently, India has operational Social Security Agreements with the following 18 countries: Belgium, Germany, Switzerland, Denmark, Luxembourg, France, South Korea, Netherlands, Hungary, Sweden, Finland, Czech Republic, Norway, Austria, Canada, Australia, Japan and Portugal. Key change •As per the circular dated 30 June 2017 issued by the EPFO, the Certificate of Coverage application form has been revised. •The footnote to the revised application form also mentions that the revised application form is to be scanned, uploaded and to be digitally signed by employer. •The following revisions have been made in the Certificate of Coverage application form: •Introduction of the following details: Comment •Universal Account Number (UAN) •Aadhaar number The EPFO continues to address concerns of the industry and to work toward ease in social security compliance for both International Workers and Domestic Workers. The latest circular from the EPFO revising the Certificate of Coverage application form is a positive change and may bring relief to Indian employers when applying for Certificate of Coverage. •Start date and end date as per work permit of host country •Email address and phone number of the employee and the Indian employer •Details of the employer in the host country •Removal of the following details: •Employee’s EPF registration number •Accompanying family •Type of business activity
